The condition of the above obligation is such that if the above bound Samuel Lowrimore does make or cause to be made to the male heirs of the aforesaid Thomas and Nancy Hall all and singular the right and title to the tract of land whereon the said Nancy and Thomas Hall now live adjoining Thomas Oliver and others then the above obligation to be null and void and of no effect, otherwise to be and remain in full force and virtue in law, given under my hand and seal the day and date above written. Samuel Lowrimore Seal "Signed sealed in presence of, conditions before delivered, after the conditions and second seal the title is be executed in three months from date and the said Samuel Lowrimore is to reserve to himself the guardiianship of or to the said land in the title. Webb James Phillips" "On 7 May 1855 the following petition to the court was made: Georgia, Elbert County - To the Honorable Court of Ordinary of said county, the petition of Jackson Hall, Simeon Hall, Lindsay Hall, Alexander Hall, James Hall, Marion Hall and William Hall, male children of Thomas and Nancy Hall, showeth that heretofore to wit on the 13th day of November 1839 Samuel Lowrimore of said county then in life, since deceased, made and executed to your petitioners his bond (a copy of which is annexed to this petition) binding himself in the sum of two hundred dollars, conditioned to be void if the said Samuel Lowrimore should make or cause to be made to your petitioners titles to the tract of land whereon Nancy and Thomas Hall lived at the date of said bond joining at that time lands of Thomas Oliver and others on Doves Creek in said county containing one hundred acres more or less said tract now being that whereon the said Nancy and Thomas Hall still live and joining at this time lands of Zachariah Kidd, Magbee and Eppy W. Bond..And your petitioners aver that the said Samuel Lowrimore departed this life in 1854 without executing or causing or providing in any way for titles to be executed to your petitioners for said tract of land, and your petitioners aver that they have faithfully performed their part of the contract under which said bond was given - Wherefore our petitioners pray that Joseph Sewell Administrator of the estate of said Samuel Lowrimore deceased may be ordered and directed by the Court to execute to your petitioners titles for said tract of land in conformity with said bond of said Samuel Lowrimore deceased and as in duty bound your petitioners will ever pray -- May 7th 1855." At Court of Ordinary, May Term, 1855, it was ordered that all persons concerned are hereby notified to show cause if any they have on or before the first Monday in September next why said Joseph Sewell should not be directed to execute the titles. [Submitter's notes: Thomas Hall was the son of William Hall and Sarah Blake. His wife Nancy was the daughter of Samuel Lowrimore. The witnesses to Samuel's bond - Urbin A.
