Record Book 1830-35, Page 316 Written: February 11, 1833 Recorded: September 4, 1833 The Last Will and Testament of William Lunceford Sen of Elbert County in the State of Georgia. I William Lunceford Senr. considering the uncertainty of this mortal life and being of sound mind and memory (blessed be Almighty God for the same) do make and publish this my last Will and Testament in manner and form following (that is to say) I will that all my just debts as shall be by me owing at my death together with my funeral expences and all touching the proving of or otherwise concerning this my Will shall in the first place out of my personal Estate and effects be fully paid and sattisfied, and from and after payment thereof and subject thereunto then my will is First that my beloved wife Rachel M. Lunsford shall have one black horse saddle and bridle and further it is my will that all the residue of my goods stocks chattles household furniture and all lands in any way belonging to me after my death shall be sold at public auction and shall go to the support of my beloved wife Rachel M. Lunsford during her life time all moneys belonging to me or received for the sale of my property shall be put out at Interest In the next place after the death of my wife Rachel M. Lunsford it is my will that all my Estate and the profits thereof shall be Equally divided amon my children namely Rolle Polly Robert James Katy William George Peggy Addie and Patsy Lunsford. I do hereby make and appoint my sons James and William Lunsford Executors of this my last Will and Testament, and lastly, my express will and meaning is and I do hereby order and appoint that if any difference dispute question or controversy shall be moved arise or happen concerning any gift bequest matter or thing in this my Will given and bequeathed expressed or contained that then no suit or suits in law or equity or otherwise shall be brought commenced or prosecuted for and concerning the same but the same shall be refered wholly to the award order and determination of my friends Mr. William Burdden and Abram Brown and Hugh A. Wiley all of them of Elbert County in the State of Georgia and what they shall order direct or determine there in shall be binding and conclusive to all and every person and persons therein concerned. In witness whereof I have hereunto set my hand and seal the Eleventh of February in the year of our Lord one thousand eight hundred and thirty three. his Attested by us William X Lunsford,Senr. Wiley two of the subscribing witnesses to the above written Instrument and being duly sworn saith that they saw William Lunceford Senr. sign and publish the above written Instrument as his last Will and Testament and that they signed the same as witnesses in his presence and at his request and that he was then of sound and disposing mind and that they also saw Wesley Pledger subscribe the same as a witness in his presence.
