Decd 1869 Georgia } In the name of God Amen Elbert County } I Elijah Benson Norman Senr. of said State and County being of advanced age and knowing that I must shortly depart from this world, deem it right and proper both as it respects myself and family, that I should make a disposition of the property with which kind Providence has blessed me. And being of sound and disposing mind, I make this my last Will and Testament hereby revoking and annulling all others heretofore made by me. Item First: I desire and direct that my body be buried in a decent and Christianlike manner, my soul I trust will return to God who gave it as I hope for eternal Salvation through the blessed Lord and Saviour Jesus Christ whose religion I have professed and as I humbly trust enjoyed for twenty six years Item Second: I desire and direct that all of my just debts be paid without delay by my executors hereinafter named, as I am unwilling my creditors should be delayed their rights especially as there is no necessity for delay Item Third: I give and devise to my beloved wife Jane S. Norman all my lands on which my dwellings now is, South west of the Franklin road containing Seven hundred Seventeen acres more or less. I also give my wife a Buggy and the farming utensils used on the said plantation of every description whatever and four horses and as many cows and hogs as she may choose from my stock of cattle & hogs for her own benefit. All my household and kitchen furniture except as such as is hereinafter otherwise disposed of. Item Fourth: I give and bequeath to my beloved wife for and during her natural life ten negroes which she may choose from all that is left after the dispositions made in items fifth, sixth, seventh, eight, ninth, tenth, and eleventh of this will. I desire moreover that she have one year’s provisions and five hundred dollars in money. At the death of my wife I desire an equal distribution of the above named property to be made between my children hereinafter named. Item Fifth: I give and bequeath to my daughter Sarah Ann Norman wife of Jeptha W Norman a negro girl named Evelina about Seventeen years of age and Myry a negro girl about fourteen years of age now in the possession of said Jeptha W and Sarah Ann Norman except Myry which he has now disposed of Item Sixth: I give and bequeath to my son William T my negro boy named Oliver about nineteen years of age which he now has disposed of and a girl named Harriet about 10 years of age, which he has also disposed of Item Seventh: I bequeath to my daughter Mary M Teasley wife of Jas. R. Teasley my girl named Mary Ann about eighteen years old and a negro boy named Raiford about twelve years of age which two negroes are now in the possession of said Jas. R and Mary M Teasley. Item Eighth: I bequeath to my son Carter B. a negro boy named Lindsay about Seventeen years of age which he now have in possession and a negro girl named America a daughter of Fannie’s aged about nine years and now in my possession. Item Ninth: I bequeath to my son Elijah B my negro boy named Middleton about sixteen years of age which he has now disposed of and a negro girl named Rilla a daughter of Lou’s about nine years old. Item Tenth: I bequeath to my son Henry P. my negro boy named Jim about twenty three years of age and my negro girl named Mary a daughter of Betsey about eight years of age said girl now in my possession. Item Eleventh: I bequeath to my son James J L my negro boy named Manuel about twenty years of age and a girl named Sallie a daughter of Betsie’s about six years of age now in my possession. Item Twelfth: It is my will that of all the abovenamed dispositions should any of the property die or in any way become deficient before it is received by its proper and hereinnamed owners such deficiency shall be supplied from the undivided portion of my estate. Item Thirteenth: It is my will that the remainder of my property both real and personal whereever and whatsoever it may be, I devise and bequeath to my several above named children to them and their heirs forever. Item Fourteenth: I constitute and appoint my beloved wife Jane S Executrix and my son William T Executor of this my last will and Testament this twenty eighth day of December A.D. one thousand eight hundred and fifty nine. Higginbotham Subscribing witness to the foregoing instrument of writing who being sworn, saith that he was present and did see Elijah B Norman Senr. the within named, sign, seal and publish, and declare the same to be his last will and testament; that he was of sound and disposing mind and memory, and that this deponent together with B.C. Smith and Talison Norman signed the same as witnesse’s at the request, and in the presence of the Testator and of each other Sworn to before me this 4th Day of March 1869 } E.B. Norman Senr. late of Elbert County deceased having been propounded for probate in Common form by William T Norman and Jane S. Norman the nominated Executors therein and having been proved by the oath of Daniel T. Higginbotham one of the subscribing withesses there to. It is ordered that the same be admitted to record and they having applied for Letters Testamentary Ordered that said letters issue to them accordingly that William H. Adams, Jackson P Maxwell, James M. Hannam, Alfred J Teasley and Thomas J Bond be and they are hereby appointed appraisers to appraise the property of said deceased March 4th 1869 E.B. He married Jane Satterwhite Higginbotham (July 28, 1797 – July 7, 1884) on April 3, 1821. Jane Satterwhite Higginbotham was the daughter of John Satterwhite Higginbotham and Ann Staunton and granddaughter of Revolutionary War veteran Samuel Higginbotham (Knight’s Roster of Revolutionary Soldiers) and Jane Satterwhite.
