Will of Wilson Penn 19 May 1811 Elbert County, GA Recorded in Will Book 1809-1812, pages 252-254, Elbert Co., GA In the name of God Amen, I Wilson Penn of the State of Georgia and County of Elbert being weak in body but sound & perfect mind and memory (blessed be to Almighty God for the same) do make & publish this my last will and testament I the manner & form to wit. It is my will that one half of my stock of cattle, hogs, & sheep shall be disposed of as soon as convenently can be, & all my just debts discharged out of my monies arising therefrom. 2nd It is my will that my beloved wife Frances Penn together with my afternamed executors shall whenever they deem it for the advantage & benefit of said wife & children, dispose of my landed estate & with the money arising from said sale together with any monies which may remain from the sale of stock, after the payment of my just debts as above stated, purchase land again whenever my beloved wife may wish. 3rd The land so purchased together with all my other property & its increase given them in the following manner (to wit) as they marry or become of lawful age, my wife with my executors shall give them or any of them that may so marry or come of age as above stated what part of the property they may think can be conveniently spared having regard to an equal distribution of the same & the comfortable support of my Dear wife & our children who may remain with her. At the death of my said wife, an equal distribution of what may be remaining with her calculating what any of them may have had given them of said property previous to her death. 4th It is my wish that my friends Colo Benjamin Taliaferro, Doctor John G. (T) Gilmer & Thomson Watkins should act as Executors together with my Dearly beloved wife Frances Penn executrix to this my last will and testament. In testimony whereof I here unto set my hand & seal the 19th day of May 1811. Fortson Justices of the Inferior Court for the county aforesaid, Caleb Higginbotham, Wm Brown and Charles Williford witnesses to the within will who being duly sworn saith that they were subscribing witnesses to the within will and that they saw Wilson Penn sign seal and deliver the same as his last will and testament and that he was of sound disposing mind & memory or appeared so to be at the time of signing the same -- and that these _____?_____ subscribed the same as witnesses at the testators request and in his presence sworn to the 4th day of November 1811 before us A. Gilmer & Thompson Watkins do solemnly swear that the writing produced in Court and here with shewn, is the last will and testament of Wilson Penn -- deceased so far as we know or believe and that we will well and truly execute the same by paying first the debts, and then the legacies contained in the said will as far as the goods and chattles will thereunto ____?____ and the law charges us with, and that we will make a true and perfect inventory of such goods and chattles.
