Record Book 1830-35, Page 32 Written: March 24, 1827 Recorded: September 8, 1831 "Georgia, Elbert County) I Barnabas Pace of the State and county aforesaid being of sound mind and memory but being old and calling to mind the uncertainty of life do make and ordain this my last Will and testament. First, it is my will and desire that my beloved wife Mary Pace do have the full control of all my estate both real and personal during her natural life or widowhood so as not to dispose of by sale of neither lands nor negroes and that my Executors do see that she is comfortably supported during the aforementioned period out of the same. Secondly, that my Executors do pay to my grandson Barnabas Pace the sum of three hundred and thirty nine dollars at the expiration of the aforesaid period. Thirdly. It is my will and desire that my Executors after the payment of the above legacies, divide my estate both real and personal as soon as it can conveniently be done into nine equal shares, to be divided in the following manner (that is to say) One share or ninth part to go to my beloved son Thomas Pace, 1 sh to my beloved son Bazil Pace, one share to my beloved son Noel Pace, to my beloved son-in-law John Cazy who married my daughter Elizabeth fifty dollars less than an equal share. To my beloved son Dredzil Pace one share, to my beloved son-in-law who married my daughter Nancy two shear Burket Wilborn to my beloved son Paris Pace fifty dollars less than an equal share, and to my grandson Barnabas Pace one share. Fourthly. I do hereby make null and void all former Wills heretofore made by me in any wise touching the premises and that my Executors do see to the payment of all of my just debts. Fifthly. I do hereby nominate and appoint my son Dredzil Pace and my son-in-law Birket Wilbon and my grandson Barnabas Pace my Executors to this my last Will and testament. In testimony whereof I have hereunto set my hand and seal,this 24th March 1827. B. Pace (Seal) Signed Sealed and Acknowledged in presence of C. W. Christian William Moss, J.P." Christian who duly sworn saith that he saw the within named testator Barnabas Pace sign seal and declare the within instrument to be his last Will and testament, that the said Barnabas was of sound and disposing mind and memory at the time he executed the same, that this deponent attested the same in the presence of William Moss the other of the said witnesses and the testator and at his request.
