May the 12th 1810 I, Samuel Patten though weak in body yet sound in memory do constitute this my last will and testament as Follows (Viz) first my wish is that all my debts be discharged and then that all my property remain in the hands of my loving wife Catharine Patten for the support of my family During her widowhood and then that the hole of the property be sold and the childrens part Taken out and an Equal division be made amongst them excepting one Negro girl by the name of bet her I give to my loving Daughter Polly Patten besides her equal part and my Daughter Margaret to her I give one young colt which I know have exclusive of her equal part. and I do hereby appoint my Loving wife as above named and George Eberhart and William Patten my Lawful Executors In witness where of I do hereunto seet my name this day and date above mentioned. in the presents of us-- Signed: Samuel Patten Jonathan Cooper David Eberhart Jacob Eberhart _______________________________ State of Georgia, Elbert Co - Court of Ordinary, July Term 1810 Personally appeared before me in open court Jonathan Cooper, David Eberhart and Jacob Eberhart and who being Duly Sworn on the holy Evangelist of Almighty God--Deposeth and Sayeth that they saw Samuel Patten Sign and acknowledge the written as his last will and Testament and at the time of his doing.
