Record Book 1830-35, Page 479 Written: July 29, 1834 Recorded: January 10, 1835 "Georgia, Elbert County) In the name of God Amen I Willis Rucker being of sound mind and disposing memory make and ordain this to be my last Will and Testament in form following, revoking all others. Item 1st My will and desire is that all my just debts be paid by my Executors. Item 2nd I give and bequeath unto my two loving daughters Mary and Margaret Rucker two negroes Washington and Sam to be held jointly by them until one of them marries and then the negroes to be valued and an equal part assigned to each of them and if either of my daughters Mary and Margaret die before they marry or become of age in that event it is my will and desire that such part of the above named Washington and Sam as would have been assigned to such deceased be assigned to my two sons Jerry and Peter Rucker. It is my desire and wish for my two daughters to have a bed and furniture each of them the beds are in the possession of Jacob M. Cleveland. Item 4th I give and bequeath unto my two sons Jeremiah and Peter all of my property that is not hearinbefore bequeathed to be equally divided between them. Item 5th Ordain nominate and appoint my beloved friend Peter Alexander Executor to this my last Will and Testament. In testimony I hereunto affix my name and seal in presence of Willis Rucker (Seal) July 29th 1834 Dillard Herndon Wm. A. Beck" "Codicil It is my will and desire that if my two daughters Mary and Margaret should both die before they marry or become of age in that event the property that I have bequeathed to them in my second Item of the foregoing testament be equally divided between my remaining children (viz) Permelia Cleveland, Jeremiah Rucker and Peter Rucker." Beck and being sworn saith that they were present and saw Willis Rucker of said county sign seal and acknowledge the within instrument of writing as his last Will and testament and that the said William A. Beck wrote the within codicil at the request and the time of signing said Will or Testament and that he the said testator at the time he executed said instrument of writing was of sound mind and memory and that they subscribed the same as witnesses in the presence of the testator and at his request.
