I John Statham of the county and state aforesaid being weak in body but of sound mind & memory do make & ordain this my last will & Testament in manner from follow, to wit, First my desire is that all my Just debts be paid Secondly I give unto my son James Statham one dollar to be paid him out of my estate Thirdly I give unto my son John Statham one dollar to be paid him out of my estate Fourthly I give unto my son Charles Statham one dollar to be paid him out of my estate Fifthly I give unto my son Robert Statham one dollar to be paid him out of my estate Sixthly I give all the balance of my estate both real and personal unto my sons William Statham Nathaniel Statham Jesse Statham and my daughter Nancy Barnet & Pleasant Statham to be equally divided amongst them & their heirs and do further more appoint my friends John Brown and James Christian Executors of this my last will and Testament. As witness my hand this twenty seventh day of June 1823. John (his mark) Statham Signed sealed and delivered in presents(sic) of Charles Andrews John (his mark) Statham Court of Ordinary November Term 1823, Elbert County, Georgia Personally appeared in open Court Charles Andrews and John Statham who being first duly sworn deposeth and say that they & each of them were subscribing witnesses to the written last will & Testament of John Statham & that they subscribed the same as witnesses in the presence of the said Testator & at his request & in the presence of Each other & that the said testator was of sound & disposing mind at the time he executed the same & that they saw him subscribe the same sworn to & subscribed in Court this 3rd day of November 1823.
