I Benager Teasley of the State of Georgia and county of Elbert being in a declining state of health but of sound mind and disposing memory after resineing my body to the grave to mingle with its mother earth and recommending my soul to God who gave it. Knowing that death is sure and the time uncertain and feeling a disposition to make some arrangements about my worldly affairs, I therefore make the following disposition of them (to wit) "Item the first I give and bequeath to my beloved wife Lucy Teasley after paying all my just debts and burial expenses all my estate both real and personal during her natural life or widowhood together with the increase of my said estate to manage control as she may think best for the benefit of my family and my said estate and at the death of my wife Lucy Teasley It is my will that all of my said estate both real and personal together with the increase of my said estate be equally divided betwixt all my children (viz) Elizabeth Ann, James Alfred, John Eastin, Isham Haily, Mary Jane, Lucy Meander Teasley all to share and share alike of my said estate. "Second It is my will if in case my wife Lucy Teasley should marry for her to have the sum of six hundred dollars out of my estate and the remaining portion of my estate both real and personal together with the increase to be equally divided betwixt my said wife and children as above named that may be living also the extra six hundred dollars to belong to my children at her death. "Third It is my will that if any of my said children should marry that my wife before giving off any portion of my said estate to any such child or children to have such portion valued by competent judges taking care at the same time not to give off more to one than would be their porportionable share of my said estate at a final distribution thereof provided she may have at any time more of my estate than she may think proper to keep together. "Fourth It is my will that if any of my negroes should be stubborn and will not submit and be controlled by my wife for them to be sold and others bought if she may think proper otherwise the money to be put out upon interest. "Fifth It is my will that if at any time my executors should receive into their hands any portion of property or other effects that I am entitled to as a legatee that they dispose of the same as above stated for the distribution of my estate that I am now possessed of. I do hereby appoint John A. Teasley and Thomas Johnston my lawful executors to this my last Will and Testament hereby ratifying and revoking all others. In testimony whereof I have hereunto set my hand and affixed my seal this the twenty seventh day of December one thousand eight hundred and thirty seven. Personally came into open court Barden Rucker William Brown and Joseph Crisler and being sworn saith that they were present and saw Benager Teasley now deceased sign the foregoing and annexed instrument of writing as his last Will and Testament and that they signed the same as witnesses in the presence of the testator and at his request and that they believe the testator to have been of sound mind and disposing memory at the time of executing the same.Sworn to in open court this 7th May 1838. Barden Rucker William Brown Joseph Crisler Attest Wm. B. Nelms, C.C.O. "Georgia Elbert County) Court of ordinary May Term 1838.The within last Will and Testament of Benager Teasley deceased having been proven at this regular term in open court upon the oath of Barden Rucker,William Brown and Joseph Crisler, ordered that the same be recorded.
