All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/ga/gafiles.htm ************************************************ File contributed for use in USGenWeb Archives by: George Herd rherd7491@hotmail.com December 23, 2004, 3:49 pm Source: Elbert County Will Book, 1791-1816, Page 291 Written: May 16 1810 Recorded: June 19 1810 In the name of God Amen, Know all Men by those present that I Jeremiah Terrell of the state of Georgia & County of Elbert being in Health and perfect mind and memory and calling unto mind the mortality Of my body and knowing that it is appointed for all men once to die Revoking all others do make and ordain this my last Will & Testament That is to say principally and First of all I give and Recommend my Soul into the Hands of Almighty God Who gave it and my body I¡ª Recommend to the Earth to buried in decent Christian Burial at the Discretion of my Executors, and as touching such Worldly goods Where With it hath pleased God to help me in this World. I give and Dispose Of in the Following manner and form. First I give and bequeath To my well beloved beloved Wife Louisa my plantation and mansion House where I now live to hold during her life or widowhood. 2nd, I Give and bequeath to my well beloved and Eldest, William all the Land I posses on the South Side of Pickens Creek adjoining Halsy and Others in Fee Simple Beginning at a given corner and extending North Westerly upon said creek. 3rd, I give and bequeath to my grandson John Jordan Eldest son of James Jordan the Est end of the Tract of Land I live on lying on both sides of Pickens Creek adjoining William Prewit and others containing one hundred and thirty three acres As a deed Which I have before given him will more Fully show in Fee Simple, 4th, I give to my youngest son John, after the death Or Marriage of My Wife Louisa my plantation Land and tenements Beginning at the corner of the Land Last mentioned Which was bequeathed to my grandson John Jordan at a Chestnut Corner on Pickens Creek and running with said line as it travels to Wm. Prewits line thence with said line to John Humbers lines thence With it lines to Underwoods line thence with said line to Gulleys line Thence Southwordly on whatever course said Gulleys line extends to Pickens Creek thence down said Creek to the beginning Also one block House one rifle gun one Feather Bed and Furniture an Heifer all to ¡Ìand as of Fee Hold in fee Simple. 5th, I give to my grandson Bardin Rice Taylor that part Of my land beginning next above the land bequeathed to my son John And extending up Pickens Creek adjoining Northwardly with Gulleys and Others till it should Intersect the lines of one Hundred acre Tract Which Must First belaid off. For my Daughter Polley and Which I have With Consent of My said Daughter Conditionally Sold to William Craft the said Bardin Rice Taylor hold all the land Which my Grant covers Between the land above Willed to my Son John and Conditionally sold to Said William Craft. 6th, I give to my Daughter Polly Terrell one Hundred acres of Land to be laid off of the upper end Of my tract the same Hundred acres Which is above Mentioned Conditionally sold to William Craft If said Craft does not comply with The conditions of a Certain Bond Which I have given him for titles If said Craft does Comply with said Bond by paying for said land I give my said Daughter Polly the money arising from the sale of Said land. Also one Feather Bed & Furnitujre and one Heifer 7th I Give To my Grand Daughter Patsy Taylor one Feather bed and Furniture. 8th, for Divers reasons and causes thereunto moving. I give the Repre- sentives or Heirs of My Daughter Rachel the sum of Five Dollars¡ª 9th, I also give to the Representatives of My Daughter Louisa the Sum of Five Dollars as a Full Compensation of all part of my Estate to be paid by my Executors out of the assets in their hands 10th, I give to My Daughter Rosanna the like Sum of Five Dollars¡ª 11th, I give to my Daughter Susanna Five Dollars to be paid by my executors as aforesaid as their part of my Estate all the Balances of My Property not before given I leave to be sold and Equally Divided Between my Sons William and John & My Daughters Susannah, Rosanna, & Polly I also constitute and ordain my Sons William and John Exe- cutors of this my last Will and Testament, Sealed and Signed this 20th of March 1811 and in presence of¡ì his Teste Wm H. Underwood¡ì ¡ì Jeremiah §Ø Terrell Henry Mann ¡ì mark Farley Thompson ¡ì Georgia¡ì Court of Ordinary May Term 1816____ Elbert County¡ì Personally appeared in open court William H. Underwood one of the subscribing witnesses to the above written Will and being duly sworn saith that he saw Jeremiah Terrell Sign and acknowledge the above Written Instrument as his last Will and Testament and that he Subscribed the same as a Wit- Ness in the presence and he believes the said Jeremiah Terrell To have been then of sound and disposing mind-- Sworn to and Subscribed in Open Court 6th of¡ª May 1810 Wm H.
