Clark, of said State and county, being of sound and disposing mind and memory, do make this my last will and testament, hereby revoking and annulling all others, by me heretofore made. Item one. I desire and direct that my body be buried in a Christian like manner, suitable to my circumstances and condition in life. Item two. I desire and direct that all my just debts be paid without unnecessary delay, by my executor hereinafter named and appointed. Item three. It is my desire and will that my executor shall, out of funds belonging to my estate, pay and distribute, before calculating the value of the distributive shares, to each of my children and the children of my deceased daughter or my children that may hereafter die, an equal share in the following fund or account: My beloved wife died, leaving a small estate of personalty and of this estate, it not having been administered upon, I sold and now have the proceeds from the sale of a one hundred dollar Liberty Bond, bearing four per cent interest per annum, and the sum of $25.00 collected from Rowan Johnson upon annote owing her. This rightly and justly belong to my said children and grandchildren. Item four. I give, bequeath and devise to my children and the survivors of my deceased daughter, Maggie King, all of my estate, in equal parts, share and share alike, except that my son, James K.H. Clark shall receive only $500.00, and the children of my said deceased daughter, towit: Ira King, Clyde King and Orian King, shall take per stirpes in lieu of their deceased mother. And the child or children of any of my other children who may hereafter die shall take per strpes in lieu of their deceased parent. I estimate that the distributive shares of my said estate shall be in excess of $500.00 each, but I only give my said son, James K.H. Clark, the sum of $500.00 because I consider that I have heretofore made suitable provision for him. Further it is my desire and intention that each of my children to whom I have made loans, and which loans were intended to be repaid, shall be repaid to my estate before they can receive their distributive share. Item five. I hereby name and appoint my son, C.A. Clark, testamentary guardian or trustee of the estate or share to be received by my grandchildren, towit: Ira King, Clyde King and Orian King, children of my deceased daughter, Maggie King, and said guardian shall receive, account for and handle the funds and property I have given my said grandchildren as is provided by law in the case of testamentary guardians, including the giving of bond and making returns, but he is exempted from obtaining the order of any court as to investing, selling or reinvesting their said estate, it being my purpose that said guardian shall invest, sell and handle said estate as he deems best and proper in the interest of said minors. Further, I desire and will that said guardian shall keep said estate intact and he shall only use the income therefrom until said children reach the age of twenty one and as each child reaches the age of twenty one said guardian shall pay over and settle with such child for his or her pro rate share. Further, I make this provision and appoint said guardian for said children because their father, in my judgment, is wasteful and is not the proper person to have and handle their said estate. Item six. It is my desire and will that my executor shall sell the real and personal property belong to my estate, and convert it into cash as early as practicable and make distribution as I have provided herein. Item seven. I hereby constitute and appoint my son, C.A. Clark, the sole executor of this my last will and testament, and I expressly confer upon him power, as such, to administer my estate, excusing him from giving any bond, or making any returns to the ordinary, and I expressly confer him the full authority and power to sell any part or all of my estate at public or private sale, with or without notice, as he may deem best, and without any order of court, making good and sufficient conveyances to the purchaser and holding the proceeds to make distribution and payments as hereinbefore declared in the several items of this my will. Clark, as his last will and testament, in the presence of us, the undersigned, who, at his special instance and request, do attest as witnesses, after said testator had signed his name thereto, and in his presence, and in the presence of each other.
