Tocca River - Floating lumber

1899, July 28-- This Indenture made between the under signed citizens of Fannin 
County as of the 1st part and J. Merrick of Ashville North Carolina, party of 
the 2nd part.  Parties of the 1st part, for and in consideration of $1.00 
dollar payable to each party within one year, and for the consideration herein 
after mentioned to rent, lease and give exclusive full rights or together, with 
rights in egress and ingress to the said J. Merrick, assigned the bed of the 
Toccoa River as far as it extends through each of their lands for the purpose 
of floating lumber .  Provided  J. Merrick shall pay each and every party of 
the 1st part, all damages done to any part of their land, carops(sic) or fences 
from floating timber or lumber, it is hereby understood that as long as the 
said J. Merrick  shall protect the parties of the 1st part from the damage done 
by floating, he shall have and retain full lease of the bed of said river for 
the above purposes.
