ACTS of the General Assembly of the STATE OF GEORGIA, PASSED IN NOVEMBER AND DECEMBER, 1836. ACADEMIES. 1836 Vol. 1 -- Page: 7 Sequential Number: 005 Type: AN ACT, Full Title: To incorporate the Fayette County Academy, and appoint Trustees for the same. Sec. 1. Be it enacted by the Senate and House of Representatives of the State of Georgia in General Assembly met, and it is hereby enacted by the authority of the same, That Young Mann, William Herring, Tandy D. King, Thomas Byrne and William W. Coker, be, and they are hereby appointed, and they and their successors in office, are hereby declared to be a body corporate, by the name and under the title of the Trustees of the Fayette County Academy. Sec. 2. And be it further enacted, That the Trustees aforesaid, and their successors in office, be, and they are hereby invested with the power of using a common seal, of suing and being sued, pleading and being impleaded, in the several courts of law and equity in this State; of making all necessary by-laws for their government; of holding title to, and conveying real and personal estate, and of doing all other things, and of enjoying all other immunities, not inconsistent with the Constitution and laws of this State, which may be necessary to the well being of said corporation, and of filling any vacancy that may take place in their body. Sec. 3. Be it further enacted, That in all cases where vacancies shall occur, either by death, removal, resignation, or otherwise, it shall be the duty of the remaining Trustees, to fill such vacancies. Sec. 4. Be it further enacted by the authority aforesaid, That his Excellency the Governor, be, and he is hereby authorized to draw his warrant on the Treasurer, in favor of the Trustees of Fayette County Academy, for such dividends as may be due said institution, on the application of any one of the Trustees, any law to the contrary, notwithstanding. Sec. 5. Be it further enacted, That all laws and parts of laws militating against this act, be, and the same is hereby repealed. JOSEPH DAY, Speaker of the House of Representatives. ROBERT M.
