Amen. I, Fayette County) Haywood Thornton of said State and County being middle age and of sound and (illegible)mind and memory, (illegible) and leaving to go into the service of the Confederate States of America deem it right and proper, both both as respects my family and myself that I should make a distribution of the property with which a kind providence has blessed me do therefore make this my last will and Testament, hereby revoking and nullifying(?) others by me heretofore made. First--I desire and direct that my body be buried in a decent and Christianlike manner suitable to my circumstances and condition in life. My soul I trust shall return to rest with God who gave it as I hope for salvation through the merits and atonement of the blessed Lord and Savior Jesus Christ. Secondly--I desire and direct that all my just debts be paid without delay by my Executor hereafter named and appointed. Thirdly--I give bequeath and _____ to my beloved wife, Mary the East half of lot of land number two hundred and and [sic] fifty-one (251) in the fifth (5) district of originally Henry now Fayette County, containing one hundred one and a quarter acres with all the rights ____(illegible) and appurtances, to said tract or (illegible) of land in any wise belonging to her own (illegible) use for and during her natural life time or widowhood. Then sold and divided between my hereafter named children, I also give and bequeath to my beloved wife East half of lot Number two hundred and fifty-five (255) containing one hundred one and quarter acres in the seventh (7) district of Fayette County for the benefit and use of my family until my children HEROD and JORDAN, ELIZABETH, HAYWOOD, and BENNETT B. and MARY Each of these becomes twenty-one years of age after which time it must be sold and divided between my above named children and my beloved wife Equally. Fourthly-- I give and bequeath to my beloved wife for use during her natural or widowhood only, the farming utensils used on and belonging to this farm on said tract of land and my horse and all my cattle and all my hogs and sheep and all my household and kitchen furniture. And the residue of my property both real and personal whatever or wherever it may be. Therein is to be sold and Equally between my Children. HEROD, JORDAN, ELIZABETH, HAYWOOD, BENNETT B. amd MARY. Fifth--If my beloved wife Mary should have another child in months after my death it shall be recognized and have an Equal share of my estate with my other children.
