The submitter has given permission to the USGenWeb Archives to store the file permanently for free access. http://www.usgwarchives.net ************************************************************************ John McLean Will Georgia Fayette County, In the name of God Amen, I John McLean of said State and County knowing that I must shortly depart from this world deem it right and proper both as respects myself and my family that I should make a distribution of of the property with which a kind providence has blessed me I therefore make this my last will and testament hereby revoking and annulling all others heretofore made by me. 1st I Desire and direct that my body be buried in a decent and Christian like manner suitable to my circumstances and condition My soul I trust shall return to rest with God who gave it. 2nd I Desire and direct that all my just debts be paid without delay by my Executors hereinafter named as I am unwilling that my creditors should be delayed of their rights. 3rd I Give and bequeath to my beloved wife Martha E. McLean fifty acres of land it lying and being on the south side of lot number two hundred and nineteen in the fourth district of originally Henry now Fayette County and including the residence where I now live also all that part lot of land number one hundred and ninety eight which lies north of a crop fence commencing at the line near Jesse Jones land running East across said lot to the East line then due East through lot number one hundred & ninety nine in the same district thirty rods thus a north corner to the north line also two head of horses to be made choice of by her the said Martha E. and two cows & calfs and choice sows & pigs and five year old shoats and five fat or killing hogs & five head of sheep all of which she is to keep & poses free from all charge off and during her natural life or widowhood. If she should marry then the land revert to and become the property of my beloved son William Francis McLean and in order that she the said Martha E. may receive an equal portion of my property in case she should Marry I request that she relinquish her interest to said lands & that she then receive the sum of five hundred dollars out of my estate. 4th I bequeath to my son William Francis McLean and Allison Hurst McLean and a child yet unborned a negro woman Iseua? and her child Stephen and all of her increase to be equally divided in the year 1870 but in case the land now bequeathed to my wife Martha E. should revert to and become the property of my son William Francis then and in that case he shall not receive any part of the negro woman Iseua and her child Stephen & her increase but they be divided between my son Allison Hurst & a child yet unborned. 5th I bequeath to my Daughter Miriam S. McLean a negro girl Lithia? and two hundred dollars in money to be paid at her marriage or when she comes of age. 6th I bequeath to my daughter Rachel R. McLean the first child that my negro woman Salice may bring to life and and to hundd dollars in money to be paid at her marriage or when she becomes of age but in case she should not receive any negro as contemplated then in that case she is to receive the sum of five hundred dollars as full compensation for the negro & two hundred above mentioned. 7th I bequeath to my sons Oliver P. McLean & Joseph M. McLean lot of land number one hundred and eighty seven in the fourth district of originally Henry now Fayette County to be divided between them by a line running from north to south in case they cannot agree upon a division that they draw for it after running the line. 8th I bequeath to my son Hiram H. McLean all of that part of lot of land number one hundred & ninety eight (198) in the fourth district of originally Henry now Fayette County which lies south of a line to commence on the west side of said lot at a crop fence near Jesse Jones land & running due East a long the line of the land bequeathed to Martha E. McLean fifteen Rods past the center of said lot then due south to the south line of said lot. 9th I bequeath to my son John M. McLean all that part of lot of land number one hundred & ninety eight which lies south of a line commencing at the crop fence fifteen rods east of the center of said lot and running east to the east line of said lot also all that part of lot n11umber one hundred & ninety nine which lies south west of a line to run due east commencing at the termination of the line that runs through lot number 198 and to run east thirty rods then due south to the south line of said lot. 10th I bequeath to my son Juanfarranzer McLean all that part of lot of land number one hundred and ninety nine which lies south of a line to commence at the center of the east line of said lot & to run due west until it runs within thirty rods of the west line of said lot then south to the south line. 11th I bequeath to my son Hampton S. McLean all that part of lot of land number one hundred & ninety nine which lies north of a line to commence at the center of the east line of said lot & to run due west until it passes within 30 rods of the west line of said lot then north to the north line of said lot. 12th I request that my negro woman Salice & my negro boy Roland remain on the plantation for the purpose of working & raising support for my family until the year eighteen hundred & sixty five at which time I request that they be equally divided among all of my heirs. 13th All the property bequeathed in the foregoing bequest is to remain as it is and to be considered a part of my estate until such heir shall become of age or marry then and in that case they will be entitled to receive their bequest. 14th I request that all the rest of my property not herein disposed of be equally divided between my (heirs) lawful heirs. 15th I constitute and appoint my beloved wife Martha E. McLean my Executrix and my sons Joseph M. McLean & Oliver P. McLean Executors to this my last will & testament this the tenth day of October eighteen hundred & fifty. Jones Justices of the Inferior Court of said County while sitting as a Court of Ordinary personally came Martha E. McLean Executrix of the last will and testament of said John McLean deceased and the witnesses of said will "Towit" Eli Edmondson Andrew McBride & Harrison Jones which witnesses being duly sworn depose and say that they saw John McLean the testator sign seal declare and publish the instrument now presented as his last will and testament freely voluntarily and of his own accord and without any compulsion or influence whatever that at the time of the Execution of the said will said testator was of sound and disposing mind and memory that deponants signed said will as witnesses in the presence of the testator and at his special instance and request and in the presence of each other.
