This Indenture made this the twentieth day of June eighteen hundred thirty 
seven between Philip Burns of the one part and John Ellis of the other part 
Witnesseth that the said John Ellis for and in the consideration of the sum of 
five hundred and twenty five dollars to him in hand paid at and before the 
sealing and delivering of these presents the receipt whereof is hereby 
acknowledged hath granted bargained sold and conveyed by the presents grant 
bargain sell and convey unto the said Philip Burns his heirs assigns all that 
tract or parcel of land situate lying and being in the County formerly Cherokee 
now Floyd County fifth district and fourth Section known and distinguished by 
lot No. one hundred and Forty eight (148) containing one hundred and sixty 
acres more or less to have and to hold said tract or parcel of land unto the 
said Philip Burns his heirs and assigns together with all and singular the 
rights members and appurtenances thereof to the same in any manner belonging to 
his own proper use benefit and behoof Forever in fee simple and the said John 
Ellis for himself his heirs and assigns warrant and forever defend the right 
and title thereof  against himself and against the claims of all other persons 
whatsoever.  In witness whereof the said John Ellis hath hereunto set his hand 
and affixed his seal the day and date above written.
