Written: December 11, 1837

This Indenture made this December eleventh in the year of our Lord one thousand 
eight hundred & thirty seven between John Ellis of the County and State 
aforesaid of the one part and Benjamin Echols of the same place of the other 
part.  Witnesseth that the said John Ellis for and in consideration of the sum 
of seven hundred dollars to him in hand paid at and before the sealing and 
delivery of these presents the receipt whereof is hereby acknowledged hath 
granted bargained sold and conveyed and by these presents grant bargain sell 
and convey unto the said Benjamin Echols his heirs and assigns all that tract 
or parcel of land situate lying and being in the fifth Dist. fourth Section of 
formerly Cherokee now Floyd County and State aforesaid lot No. (114) one 
hundred and fourteen and one hundred and thirty nine (139) To have and to hold 
said lot of or parcel of land unto him the said Benjamin Echols his heirs and 
assigns together with all and singular the rights members and appurtenances 
thereof to the same in any manner belonging to his and there own proper use 
benefit and behoof forever in fee simple An(d) the said John Ellis for himself 
his heirs executors and administrators the said bargained premises unto the 
said Benjamin Echols his heirs and assigns will warrant and forever defend the 
right and title thereof against themselves and against the claim of all other 
persons whatever.  In witness whereof the said John Ellis hath hereunto set his 
hand and seal the day and year above written.  Signed sealed and delivered in 
presence of
