All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/ga/gafiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Bob Ellis http://www.genrecords.net/emailregistry/vols/00017.html#0004075 and Linda Ellis August 12, 2007, 9:17 pm Written: January 4, 1848 James McCain to Radford Ellis No. 879 in D3-S4 The State of Alabama, Randolph County This Indenture made and entered into between James McCain of the County and State aforesaid of the first part and Radford Ellis of Floyd County and State of Georgia of the second part, Witnesseth that on the fourth day of January (1848) one thousand eight hundred and forty eight the said James McCain of the first part hath granted bargained and sold and do by these presents for and in consideration of the sum of twenty five dollars to me in hand paid the receipt of which is hereby acknowledged do grant bargain sell and convey all the rights title and claim of whatsoever natur thereunto belonging unto the said Radford Ellis his heirs and assigns forever and the said James McCain binds himself his heirs and assigns to warrant and forever defend unto the said Ellis against the right of any other persons whatsoever all that tract or parcel of land lying and being in the County of Floyd and State of Georgia known and distinguished as Lot No. 879 third District and fourth Section unto him the said Ellis for his own proper use in fee simple. In witness whereof he has hereunto set his name and afixt his seal the day and date above written. Testees AsberyWhite Isaac (c) Noland (his mark) S. Moon, J.P. The State of Alabama Randolph County Personally came before me Isaac Noland and after being duly sworn deposeth and sayeth that he saw James McCain sign the within deed and that Asberry White and himself asigned the same as witnesses in the presence of and actin Justice of Pece.
