ITEM 1st: I desire and direct that my body be buried in a decent and Christainlike manner, suitable to my circumstances and condition in life. That H.M. Patterson & Son have charge of my body and the Pastor of West End Baptist Church have charge of the Funeral Service. Burial to be in Westview Cemetery. ITEM 2nd: I desire that all my just debts to be paid by my executor hereinafter appointed. ITEM 3rd: I give, bequeath and devise to My Seven Children; the items specified below and to my Niece, Mrs. H.G. (Pearl) Anderson, those specified for her. To my Son; Henry T. Avery, the Masonic Emblem Picture left by his Father, the late Henry Robert Avery. The Two piece luggage set, Bed, Spring and Mattress in front bed room and the white knit Bed Spread, To my Daughter: Mrs. Gertrude Peters, Sewing Machine, Kitchen Stove, Kitchen Cabinet, Electric Clock in Kitchen and Rocker in front Bed Room. To my Son; Eddie Lee Avery, the Silverware, Two Bed Spreads, all Linens and Towels and all tools. To my Son; Marvin Lester Avery, the Antique Bed, Spring and Mattress, Electric Refrigerator, Mirror over Mantel and Radio he gave me. To my Son; Jesse H. Avery, Chifferobe in front Bed Room, Porch Glider, Family Picture made at Norwood, Gal, Gold Rim water and ice Tea Glasses, Floor Lamp in Living Room and Brown Blanket he gave me. To my Daughter; Mrs. Louise Hinson, the Dining Table, Serving Table, Dining Chairs, China Cabinet, Buffet, Family Bible, small armless Rocker in my Bed Room and Electric Fan she gave me. To my Son; Robert Louis Avery, Utility Cabinet, Living Room Suite, Dresser in my Bed Room and small Rocker on Front Porch. I desire and direct that each of the above Children receive a good Quilt made by me. To my Niece; Mrs. H.G. (Pearl) Anderson, I give the large Front Porch Rocker, Green Chenille Bed Spread, Yo-Yo-Quilt and Doll on the Cook Stove. I further direct the remainder of the House Furnishing be divided between the above mention Children, If so desired, If not, to be sold and the proceeds from sale to be added to $500.00 Life Insurance with the Life Insurance Co. Of Virginia and used to defray expenses of my funeral. I further direct that my just debts be paid from a Saving Account with West End Branch of Atlanta Federal Saving & Loan Assn. (Should there be any at the time of my death) and a suitable Tombstone be placed on Cemetery Lot with Family Name. Balance of said Savings Account, (if any) to be divided equally between the Seven above mentioned Children, share and share alike. ITEM I name and appoint My Son; Henry Thomas Avery to serve with Bond, as Executor of this, my last will and testament. Such Executor shall not be required to or file any inventory or appraisement or to file any annual or their returns or report to any court or to give any bond or to secure any order or consent of any court to carry out any of the powers conferred on him, her, or them, or to make any other reports to any court, but shall furnish at least annually a statement of receipts and disbursements to each person then entitled to income from my estate and to each of the residuary legatees. Said Executor may, while acting in any capacity hereunder, from time to time as he, she or they may think necessary or deem best, exchange or sell any property, real or personal, either at public or private sale at such prices and places, upon such terms, and with or without advertisement, as he, she or they may think necessary or deem best, without previously procuring the order of any court authorizing him, she or them so to do; may hold in the same form of investment, any property, real or personal, of which I may die possessed; may borrow money or renew any loans made by me and give security for repayment thereof by mortgage, loan deed, or otherwise; may lease any property for any time regardless of the duration of the administration of my estate. King (signature) Caution – For this will to be legal in Georgia, it must be witnessed by three people. The person making the will must actually see these witnesses sign as witnesses.
