Colquit resident of said county, departed this life on the 8th day of February 1871 leaving your petitioner as his Friend and also leaving a large estate of Real and personal property worth the sum (blank) Dollars and at the time of his death the said James H. Colquit was entirely intestate as your petitioner and herein aledges therefore he prays the usually citation in such cases to issue in order that he may obtain permanent letters of administration on James H. Colquit estate and your petitioner will ever pray. 24th February 1871 Samuel Johnson At Chambers 24th Febry 1871 The above and foregoing petition of Samuel Johnson that he may obtain letters of administration having been secured and considered by my order that the usual citation issued H. J. Johnson Ordiny (Annual Return filed in Ordinary’s office in Floyd County Recorded in Book D of Annual Returns No 192—pages 557, 558 & 559 Jan. 6th 1873 Administration Award Recorded in Annual Returns in book D No 183 Pages 559 & 560 Returns mentions J. T. Pullen, C. H. Smith, Wm. E. Colquit, C.M. Dwenell, C.C. Mckenzie and State & county tax). Will of Elizabeth O. Colquitt Wife of James H. Colquitt Georgia ] Floyd County ] I, Elizabeth O. Colquitt of said state And county being of sound and disposing mind and memory, but Mindful of the uncertainty of human life, do make this my last will and testament, revoking all others heretofore made. Item First: I desire that my body shall be properly buried And that all my just debts be paid. Item Second: I give and bequeath to my nephew and nieces to- Wit- Larkin Barnett, Emma Barnett, Jessie Barnett and Bessie Barnett, who are the children of my brother Charles K. Barnett deceased, all my property both real and personal which I may die possessed of, share and share alike. Item Third: I hereby make constitute and appoint my brother Daniel W. Barnett the executor of this my last will and testament, and authorize and direct him to give to each of the legatees mentioned in the second item of this will their share of the property therein bequeathed when each legatee shall arrive at the age of twenty one years, or before that time if my executor sees proper to do so. In case he should turn over to any of the said legatees their share while still minors, the minor receiving his or her share is authorized to give a full and clear receipt to said executor and the same shall be as full acquittance to said executor as if the minor had arrived at majority. I clothe my said executor with power to use the income of the share of each legatee, or so much as may be necessary, for his or her maintainance and education: also with power in his discretion to use a part or all of the corpus of each share for the same purpose. I hereby authorize and empower my said executor to sell at private or public sale, without order from any court, any or all the property herein bequeathed and to reinvest at his discretion, and to have the same powers as to the reinvestment. In no case is a purchaser required to see the application of the purchase money. In execution of this will I hereto set my hand and seal this 25th day of April A.D. 1891. E. O. Colquitt (L.S.)
