I therefore make this my last Will and Testament hereby revoking and annulling all others heretofore made by me. Item First. I desire and direct that my body be buried in a decent and Christian like manner suitable to my circumstances and condition. My soul shall return to rest with God who gave it, as I hope for eternal Salvation through the blessed Lord and Saviour Jesus Christ. Item Second. I desire and direct that all my just debts be paid as soon as the money can be collected by my Executors hereinafter named, as I am unwilling my creditors be delayed of their right longer than necessarily be avoided. Item Third. I give and devise to my beloved wife Susannah, with whom I have lived in the strictest quiet and love for about Thirty eight years, Lot number one hundred and Seventy eight (178) and Seventy acres of lot number one hundred and seventy seven (177) in the twenty second district and Third Section of originally Cherokee and now Floyd County and State aforesaid, containing when added two hundred and thirty (230) acres it being the place or farm whereon I now live, together with all my household and kitchen furniture, farming tools, and also all my stock of every description, except such stock as shall be deemed as surplus, or more than is required necessarily, for the use and benefit of the farm, all of which here named in item third I give and bequeath to my beloved wife Susannah for and during her natural life. Item Fourth. I give and bequeath to my beloved wife, for and during her natural life, my Negro man Green. Item Fifth. At the death of my wife, it is my desire and I hereby give and bequeath to my four youngest children, (viz.) Susan jane, William Milton, Joseph Jackson, and Benjamin Franklin, my land or home farm, named in item third that I have bequeathed to my wife for and during her natural life, at the death of my wife the place whereon I now live to be equally divided as to quality and value, with my four youngest children above named. Item Sixth. I give and bequeath to my three youngest sons, William M., Joseph J., and Benjamin F. a horse saddle and bridle when they shall arrive to the age of Eighteen years. Item Seventh. It is my desire at my death, what lands I may own except the farm whereon I now live, be sold by my Executors and all money that may be due to me over and above, what will pay my just debts, when collected be equally divided amongst all my children, as soon as the nature of the case will admit after my death. Item Eighth. At the death of my wife, it is my desire that the Negro man Gteen be sold, together with all the stock, farming tools, household, and kitchen furniture, and the money equally divided amongst all my children, by my Executors. Item Ninth. Should I soon be called from time to eternity, I desire what surplus stock I may have, which at this time is a good young horse, and a young mule, and some cattle, and some hogs, be sold by my Executors and the money equally divided with all my children, and further I desire at my death if there should be any rather unruly horses or mules that would not be suitable for my wife and young children to manage and work with, that my Executors sell them and replace them with others that would in their judgment be suitable for the use of the farm. Item Tenth. I constitute and appoint George W. Loyd and Thomas N. Loyd, two of my sons, Executors to this my last will and testament, this second day of August Eighteen hundred and fifty three 1853.
