Mitchell } Georgia } Franklin County } This Indenture made & Entered into thirteenth day of October Eighteen hundred & forty two Between William Crow of the one part & William W. Mitchell of the other part both of the County & State aforesaid Witnesseth that the Said William Crow hath this day made & delivered to the said William W. his certain promissory note Subscribed with his own hand & bearing even date with these presence Whereby the Said William Crow hath promised to pay the Said William W. or bearer Three hundred & Six dollars & twenty five cents on or before the twenty fifth day of December Eighteen hundred & forty three for value received Now for & in consideration of the Sum of five dollars to the said William Crow in hand the receipt whereof is hereby acknowledged, as for the better securing the payment of the aforesaid promissory note the said William Crow hath granted bargained sold & conveyed and do by these presents grant bargain sell & convey unto the said William W Mitchell his heirs and assigns all that tract or parcel of land containing Two hundred & thirty five acres more or less lying on the waters of Nails Creek Begins at a Post oak Thence North East to a pine Thence S. 80. 25 chs to a lightwood stake Thence North to a white oak on Stors line thence East with Stors line to a Stake, thence N to a rock thence Ea to a persimmon thence S to a chesnut thence Ea to a Post Oak on Charles Bakers line, thence S. to a lightwood Stake on Wylys line thence W. 31 chs to the Beginning To have & to hold said bargained land and premises to the said William W. his heirs and assigns to his & their own proper use benefit & behoof forever And the Said William Crow for himself his heirs Executors & administrators, the said bargained premises unto the said William W. will warrant & forever defend against the claim of himself & his heirs & against the claim of all other persons whatever Provided Nevertheless that of the said William Crow his heirs Executors & administrators shall and do well & truly pay or cause to be paid unto the Said William W. his heirs and assigns the aforementioned Sum of Three hundred & six Dollars & Twenty five Cents on the day & time mentioned & appointed for the payment thereof in the Said promissory note mentioned with lawful Interest for the same according to the tenor of said note then & from thenceforth as well this present Indenture & the right to the property thereby conveyed as the said promissory note shall cease, determine & be void to all interests & purposes In testimony whereof the said William Crow hath set his hand & seal the day and year above written Signed Sealed & delivered (_______/Indentured in the fifth line before Signed in the presence of his Thos Morris William c Crow SEAL L M Mitchell JIC mark Recorded 1st day of Nov. 1842
