All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/ga/gafiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Robert Meadows rwmeadows@charter.net August 5, 2003, 7:11 pm Written: August 2 1787 Charles & Sarah Gilbert to John Payne, 2 August 1787 Franklin County, Georgia, Deed Book C, left-hand page of folio 17: State of Georgia This Indenture made the 2d Day of August in the Year of Our Lord One Thousand seven Hundred & Eighty seven and in the 11th year of our Independence of the United States of America Between Charles Gilbert and Sarah his wife of the County of Franklin & State aforesaid of the One part & John Payne of the s'd State and County of the other part Witnesseth that the said Charles Gilbert and Sarah his wife For and In consideration of the sum of Forty pounds Lawfull money of s'd State to him in Hand paid by the s'd John Payne the [The word "the" is lined through.] at on or before the sealing and Delivery of these presents the receipt whereof is hereby acknowledged, Granted Bargained sold released and confirmed and by these presents doth Grant Bargain sell release and confirm unto the said John Payne his Heirs and assigns all that tract or parcele of land containing One Hundred and twenty five acres situated lying and being in the County of Franklin in the said State being the half of a certain tract of Land containing two Hundred and fifty acres lying and being on the Waters of Big Shoal Creek meetting and bounding by Charles Gilberts Land on the One side & on all other sides by Vacant Land at the time of the Survey thereof-- Together with all and singular the rights members and appurtenances thereof whatsoever to the said tract of land being belonging or in any wise appertaining and the remainders reversions rents Issue and profits thereof, and of every part thereof, To have and to hold the said tract of land and all and singular the premisses & appurtenances thereunto belonging as aforesaid and every tract thereof To have and to hold the said tract of land and all and Singular and every part thereof unto the said John Payne his Heirs and assigns forever to the only proper use Benefit & Behoof of the said John Payne his Heirs and assigns for ever and the said Charles Gilbert & Sarah his wife for themselves and their Heirs the tract of Land and premisses aforesaid and every part thereof unto the said John Payne his Heirs and assigns against them the said Charles Gilbert and Sarah his wife for themselves & their Heirs and all and every other person or persons whatever shall and will warrant and for ever Defend by these presents In witness whereof the said Charles Gilbert and Sarah his wife hath hereunto sett their hands & seals the Day and year first above written.
