All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/ga/gafiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Robert Meadows rwmeadows@charter.net August 7, 2003, 8:23 pm Written: July 26 1790 Recorded: January 20 1791 Daniel & Nancy Ayres to Poyndexter Payne, 26 July 1790 Franklin County, Georgia, Deed Book C, left-hand page of folio 73: State of Georgia This Indenture made this twenty Sixth Day of July in the Year of our Lord One Thousand Seven Hundred and ninety and in the fourteenth year of the Independance of the United States of America, Between Daniel Ayres and Nancy his Wife of the County of Franklin and State aforesaid of the one part, and Poindexter Payne of the County aforesaid of the other part Witnesseth that the said Daniel Ayres and Nancy his Wife for and in Consideration of the Sum of thirty Pounds lawfull money of the said State to him in Hand paid by the said Poynedexter Payne at or before the sealing and Delivery of these presents the Receipt whereof is hereby Acknowledged have Granted Bargained Sold Released and Confirmed, And by these presents Doth Grant Bargain Sell Release and Confirm unto the said Poyndexter Payne his Heirs and assigns all that Tract or parcel of Land containing Two Hundred & thirty one Acres Situate lying and being in the said County of Franklin in Said State on Toogaloe River Begining at a poerSimmon Runing S. 60 West 30 chains to P.O. So. 30 East thirteen chain to Stake South Sixty West thirty one chain Red Oake North thirty West Seventy Seven Chain to R. Oake on the River thence [right-hand page of folio 73, later numbered "73b"] down as it meanders to the begining Butting and bounding N.E. by Toogaloe River, S.E. Clevelands & unknown Land and S.W. by unknown Land Together with all and Singular the Rights members & appertenances thereof whatever to the said Tract of Land being belonging or in any wise appertaining and the Remainders or Reversions Rents Issues and profits thereof and every part thereof to have and to hold the said Tract of Land and all and Singular the premisses and appertenances thereunto belonging as aforesaid and every part thereof unto the said Poyndexter Payne his Heirs and assigns to the only proper use benefit and behoof of the said Poyndexter Payne his Heirs and assigns for ever and the said Daniel Ayres and Nancy his Wife for themselves and their Heirs the Tract of Land and premisses aforesaid and every part thereof unto the said Poyndexter Payne his Heirs assigns against him the said Daniel Ayres and Nancy his Wife and their Heirs and all and every other person or persons Whatever shall warrant and for ever defend by these presents In Witness whereof the said Daniel Ayres and Nancy his Wife hath hereunto Sett their Hands & Seals the day and Year first above written-- Signed Sealed and Deli- ) his vered in presence of-- ) Daniel D Ayres (seal) ) mark ) her William Cawthon J.P. ) Anna A Ayres (seal) ) mark NB the words and Nancy his wife Interlin'd in the fourth line after the word Ayres and in the seventh line Pounds after the word thirty which was done before Signed Sealed and Delivered-- Recorded 20th Jan'y 1791 [I finally understand "interlined."
