Meadows rwmeadows@charter.net September 3, 2003, 8:46 pm Written: September 26 1805 Recorded: October 14 1805 John Burks to Thomas Payne, 26 September 1805 Franklin County, Georgia, Deed Book P, left-hand page of folio 65: This Indenture made this twenty sixth day of September in the year of our Lord one thousand eight hundred and five Between John Burks of the County of Pendleton and State of South Carolina of the one part and Thomas Payne of the County of Franklin and State of Georgia of the other Witnesseth that the said John Burk for and in consideration of the sum of five hundred dollars to him in hand paid by the said Thomas Payne at or before the sealing and delivering of these presents the receipt whereof is hereby acknowledged, Granted Bargained Sold released and confirmed and by these presents doth Grant Bargain sell release and Confirm unto the said Thomas Payne his heirs and assigns all that tract or parcel of land containing two hundred eighty seven and a half Acres situate lying and being in the County of Franklin on the Middle fork of Broad River having such marks and forms as follows, Viz, Beginning at a red oak corner running North 65 West 76 chains to a [right-hand page of folio 65] Red Oak corner Thence South 25 West 38 chains to a hickory corner thence South 65. E. 76 chains to a cherry tree corner. Thence North 25 East 38 chains to the beginning-- Together with all and Singular Rights Members and appurtenances thereof whatsoever to the said tract of land being belonging or in any wise appertaining; and the remainders, reversions Rents issues and profits thereof and of every part thereof To have and to hold the said tract of land, and all and Singular the premisses and appurtenances thereto belonging as aforesaid and every part thereof unto the said Thomas Payne his heirs & assigns for ever, To the only proper use benefit and behoof of the said Thomas Payne his heirs and assigns forever, and the said John Burk for himself and his heirs, and all and every other person and persons whatsoever shall and will warrant and for ever defend the said land and premises by virtue of these presents-- In Witness whereof the said John Burks hath hereunto set his hand & seal the day and year first above written Signed sealed and delivered in presence of John Burks (seal) Robert Hackett Shrowsbery Payne Robert Walters J.P.
