John Burks Power of Attorney to Simon Terrell, 29 October 1804

South Carolina      )   I John Burks of the District aforesaid, for sufficient 
Pendleton District  )   reasons have and by these presents do constitute and 
appoint Simon Terrell of Franklin County, State of Georgia my lawfull Attorney 
and Solicitor, for me, in my name and to my uses, unrestricted to do and 
transact all and singular the things in any wise necessary to be done, 
respecting an Action of Ejectment, brought by the said John Burks against 
Thomas Davis in the Superior Court for the County last aforesaid--  
Authorizing my said Attorney to appoint One or more Persons to Act in the 
premises aforesaid, with as unlimited authorities as himself--  Hereby 
allowing

ratifying and confirming whatever my said Attorney or others to be by him 
authorized at his discretion shall do in any wise touching the premises 
aforesaid as if the same had been done by myself in Person or subscribed to 
the same with my own hand, hereby Solemnly unequivocally and finally revoking 
and making utterly void an Instrument of writing in the nature of a power of 
Attorney heretofore made and assigned by John Burks to Moses Terrell of 
Georgia, Franklin County, relating to the Action of Ejectment as aforesaid, as 
if the said Instrument had never been made.--  In Testimony whereof I the said 
John Burks have hereto set my hand and Seal on the 29th day of October 
eighteen hundred and four--

evidence with himself--
