Meadows rwmeadows@charter.net September 5, 2003, 1:51 am Written: January 29 1806 Recorded: November 17 1806 Thomas & Yannaca Payne to Thomas Davis, 29 January 1806 Franklin County, Georgia, Deed Book R, right-hand page of folio 44: State of Georgia This Indenture made the twenty ninth day of January in the year of our Lord one Thousand eight hundred & six Between Thomas Payne and Yannaca his wife of the County of Franklin and State aforesaid of the one part and Thomas Davis of the County & State aforesaid of the other part Witnesseth that the said Thomas Payne and Yannaca his wife for and in consideration of the sum of seven hundred dollars lawfull money of said State to him in hand paid by the said Thomas Davis at or before the sealing and delivering of these presents the receipt whereof is hereby acknowledged Granted Bargained Sold released and Confirmed and by these presents Do Grant Bargain Sell release and confirm unto the said Thomas Davis his heirs and assigns all that tract or parcel of land containing two hundred eighty seven & half Acres more or less Situate lying and being on the Middle fork of Broad River in the County and State aforesaid Granted to John Burks Butting and bounding as follows, Viz, beginning at a red oak thence North 65 West 76 chains to post oak Thence South 25 [degrees] West 38 chains to a pine thence South 65 [degrees] East 76 chains to a cherry tree thence North 25 [degrees] East 38 chains to the beginning [left-hand page of folio 45] Together with all and Singular the rights members and appurtenances thereof whatsoever to the said tract of land being belonging or in any wise appertaining and the remainders Reversions rents issues & profits thereof and of every part thereof and to have and to hold the said tract of land & all and Singular the premisses and appurtenances thereunto belonging as aforesaid and every part thereof unto the said Thomas Davis his heirs and assigns for ever to only proper use benefit and behoof of the said Thomas Davis his heirs and assigns for ever and the said Thomas Payne and Yannaca his wife for themselves and their heirs the tract of land and premisses aforesaid and every part thereof unto the said Thomas Davis his heirs and assigns against them the said Thomas Payne and Yannaca his wife for themselves and their heirs and all and every other Person and Persons whatsoever shall and will warrant and for ever defend the said land and premisses by virtue of these presents In Witness whereof the said Thomas Payne and Yanaca his wife hath hereunto set their hands and seals the day and year first above written [right-hand page of folio 45] Signed sealed and ) his delivered in presence of ) Thomas X Payne (seal) Simon Terrell ) mark Henry Davis ) her Yannaca X Payne (seal) mark Georgia ) This day came before me Thomas Hollingsworth one of the Franklin County ) Justices Subscribed to keep the peace for said Cty who being duly sworn saith that he saw Thomas Payne Sen'r and Yannaca his wife duly acknowledge and assign the within written Indenture as their act and deed to Thomas Davis Sen'r and as such for record and that he was a subscribing witness to the same also saw Simon Terrell Subscribe his name as a witness thereto Sworn to before me this 16th day of September 1806-- Henry Davis Thos.
