Whitney and Ruth his wife of the County and State aforesaid of the One part and John Payne of the County and State aforesaid of the other part Witnesseth that the Said William O. Whitney and Ruth his wife for and in consideration of the Sum of five hundred dollars Lawfull Money of said State to him in hand paid by the said John Payne at or before the sealing and delivering of these presents the receipt whereof is hereby [right-hand page of folio 41] Acknowledged hath Granted, Bargained, Sold, Released and confirmed and by these presents doth Grant Bargain Sell release and confirm unto the said John Payne his heirs and assigns all that Tract or parcell of land containing one hundred and fifty Eight acres be the Same more or less, Situate lying and being on the middle fork of Broad River in the County and State aforesaid it being part of a Seven hundred acre tract originally Granted to Thomas Payne, Butting and bounding as follows Begining at a Post Oak Corner on the Said John Paynes line and runing North 60 East to a Red Oak Corner thence South thirty west to a Red Oak Corner thence North 60 West to a Red Oak Corner thence to the begining Together with all and Singular the Rights members and appertainances whatsoever to the said Tract of land being Belonging or in any wise appertaining and the Remainders, Reversions, Rents, issues and profits thereof and every part thereof to have and to hold the Said Tract of land and all and Singular the premises and appertainnances thereunto Belonging as aforesaid and every part thereof unto the said John Payne his heirs and assigns Forever, to the only proper use benefit and behoof of the said John Payne his heirs and assigns for ever, and the said William O. Whitney and Ruth his wife for them selves and their heirs the tract of land [left-hand page of folio 42] and premises aforesaid and every part thereof, unto the said John Payne his heirs and assigns against them the said William O. Whitney and Ruth his wife for them selves and their heirs and all and every other person and persons whatsoever Shall and will warrant and for ever defend the Said Tract of land and premises by virtue of these presents In Witness whereof the Said William O.
