Meadows rwmeadows@charter.net October 28, 2003, 7:03 pm Written: January 25 1816 Recorded: June 3 1816 Thomas Payne (as administrator of the estate of Jacob Carlton) to David Payne, 25 January 1816 Franklin County, Georgia, Deed Book MMM, right-hand page of folio 107: State of Georgia ) This deed made and entered into this twenty fifth day of Franklin County ) January in the year of our Lord eighteen hundred and sixteen, Between Thomas Payne administrator of Jacob Carlton deceased, in right of his wife formerly Sarah Carlton of the one part and David Payne of the other part, all of the County and State aforesaid: Witnesseth that whereas the said Jacob Carlton in his lifetime and at the [left-hand page of folio 108] time of his death was in his own right possessed of a certain tract or parcel of land on the waters of Broad river containing one hundred and ninety two acres be the same more or less and which was known as a part of his Estate, the administration of which Estate hath devolved solely on him the said Thomas Payne in right of his wife, who made application to the honorable the Court of Ordinary of the County and State aforesaid for leave to sell the said tract of land for the benefit of the heirs and creditors of said Estate, after having published a rule for that purpose in the Augusta Herald for the space of nine months, being one of the public Gazetts of said State, which said Court of Ordinary having by law Cognizance of such matters and things, at a Court held in and for said County on the first monday in march eighteen hundred and thirteen, granted an order therefor authorizing him the said Thomas Payne as administrator in right of his wife aforesaid, and after having advertised the same for sale at the Court house door in said County and also in the said public Gazette for the space of sixty days agreable to law, the same was exposed to public sale and outcry at the Court house door in said County on the first tuesday in June eighteen hundred and thirteen, when the same was bid off by the said Thomas Payne himself for the sum of Eight hundred dollars he being the highest and best bidder and who has transfered [right-hand page of folio 108] and made over his bid to him the said David Payne. Now this deed witnesseth that for and in consideration of the sum of Eight hundred dollars to the said Thomas Payne in right of his wife, in hand well and truly paid by the said David Payne at and before the sealing and delivering of these presents, the receipt whereof is hereby acknowledged, hath bargained, sold, transferred his bid of, conveyed and confirmed and by these presents pursuant to the powers vested in him by law, doth bargain sell convey and confirm unto him the said David Payne all that said tract or parcel of land containing one hundred and ninety two acres more or less, situate lying and being in said County on the middle fork of Broad river being part of two surveys granted to Furman and Clark, butting & bounding as follows, begining at a hickory thence Eastwardly on Arnolds & Mathewes line to a pine, thence Southwardly to a pine on a branch, thence down the meanders of said branch to a Dogwood, thence westwardly to a water oak on the river bank, thence to the beginning hickory. Together with all and singular the rights titles, interests, claim and demand whatsoever of into, or belonging to said tract or parcel of land and premises in any wise appertaining, with the profits, benefits & advantages to the same belonging unto him the said [left-hand page of folio 109] David Payne his heirs, Executors, administrators and assigns, to his and their own proper use and behoof, To have and to hold from the said Thomas Payne as administrator in right of his wife of said Estate and from his heirs Executors administrators & assigns and from said Estate and from all other person or persons whatsoever will warrant and forever defend in fee simple.
