R.B. Russell Franklin I Judge Of the Superior Court County I Of said County I The Petition of A.W. Stephenson and His Wife Hattie Stephenson who joins him in petition show: 1st That Said A.W. Stephenson as the head of the family, on the 16th day of April 1875 filed in the office of the Odinary of Said County his application for Execption of Personaly and the setting apart and valuation of a Homestead of Realty under the Laws of Said State. 2ed That all the requirements of the Laws in such Case were fully compiled with and that on the 3ed day of June 1875. A.J Morris Ordinary of Said County approved said Applicate and all the proceedings have been recorded in the office of the clerk of the Superior Court of the said County. 3ed That The said proceeding a Tract of Land situates in said County on Stephens Creek, Adjoining lands of John Spears and the (unledgable) house containing one hundred and sixty five acers more or less,and being the place whereon petitioner there resides was seperate as part of the Housestead for said family,a copy of whitch is here attached 4th That afterwords the sold said tract of land and invest the proceeds in a tract of land situate,lying and being in said county on Stevens Creek, Adjoining lands of W. Terrell, Riley (Cot(xx) Estate of J.C. Akins D.J. Hanes and others and containing one Hundred ten acres more or less. 5th That His dwelling house is situated right on the line of said tract in order to put his said tract of Land in better shape and thereby make it more valueable, and convenient, petitioners jointly desire to sell a part of said land, lying and being on the south Western part of said tract, Beginning at the black Ginn Corners on the road running thence along said road N 13 1/2 E 5.57 to a Spanish Oak on said road, thence N 54 1/4 W 7.05 to a Post Oak, Hence S 33E. 42 links to a Hickory, thence S 1/2 E8oo to A Spainsh Oak, Thence S 73 1/2 E 3.55 to the beginning Containing Two + 69/100 acres more or less and adjoing lands of J.C. Akins, Petitioners and Ella Freeman value at twelve dollars more or less, And to reinvest the proceedings thereof in a tract or parcel of land now owned by J.C. Atkins, Lying in front of and the Line of whitch crosses very near petitioners dweling house, there being nothing but a road between them, said tract or parcel of Land beginning at a Rock on the road, running there om or N 7 8 1/4 E. to a Post Oak, Hence S..66E.3.48 to a Spanish Oak( ), Hence N 79 W. 7.00 to a Pine on Said Road, Thence along a said road to the beginning Corners, adjoing land of the petitioners and said J.C. Akins and values at twelve dollars per acer and containing Two + 29/100 Acers more or less, 6th There are no outstanding Judgements againist Petitioner, and no minor children, Wherefore, the presence counsidered petitioners pray that thay may be allowed to sell said tract or parcel of there land thus described, for reinvestment in the parcel of land described as now owned by J.C.
