Meadows rwmeadows@charter.net January 20, 2004, 9:20 pm Written: April 21 1804 Recorded: April 8 1805 John & Nancy Cross to Philip Payne, 21 April 1804 Franklin County, Georgia, Deed Book P, left-hand page of folio 15: This Indenture made and agreed to the 21st day of April in the year of our Lord, one thousand eight hundred & four, Between John Cross and Nancy Cross of the State of Georgia & County of Franklin of the one part and Philip Payne of the County & State aforesaid of the other part, Witnesseth, that the said John Cross for and in consideration of the sum of One hundred & twenty Dollars to him in hand paid by the said Philip Payne, before the sealing and delivery of these presents the receipt whereof is hereby acknowledged, hath granted, bargained, sold & delivered and confirmed and by these presents doth grant, bargain, sell, release and confirm unto the said Philip Payne his heirs, Executors, administrators and assigns forever, All that tract or parcel of Land Situate lying & being in the said County of Franklin on the waters of Little Shoal Creek containing one hundred & fifty four acres, Begining at a post oak thence East 45 chain to a pine, Thence South 17 chain, thence South West 20 chain 22 links to a black thence West 40 chain to a post oak, thence North E. 20 chain 37 links to the Begining. To have and to hold the said tract of land and all & singular the premises and appurtenances belonging thereunto, and every part thereof unto him the said Philip Payne his heirs & assigns to the only proper use benefit and behoof of the said Philip Payne [right-hand page of folio 15] his heirs Executors and administrators forever, and the said John Cross & Nancy his wife doth for themselves their heirs executors & administrators do warrant & forever defend the said land & premises to & for the said Philip Payne his heirs executors and administrators free from all claims rights titles & demands of the said John Cross & Nancy his wife their heirs or any other Person or Persons whatsoever. In Witness whereof we the said John Cross and Nancy have hereunto set our hands & seals day & year first above written. P. ) her Joseph Walters ) Nancy X Cross ) mark This day Personally came before me Nancy Cross wife of John Cross and after being privately examined saith that she has freely, willingly and voluntarily and without any [persevation ?] or being compelled by her husband, signed over all her right of Dower of the within mentioned tract or parcel of Land unto the said Philip Payne his heirs & assigns forever.
