All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/ga/gafiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Robert Meadows rwmeadows@charter.net July 17, 2003, 9:27 pm Written: September 17 1791 Recorded: September 14 1795 Heirs of Thomas Payne to Leonard Malberry 17 Sept. 1791 Franklin County, Georgia, Deed Book KKK, first entry: [This first page of the first entry in deed book KKK is numbered "1" in the upper center of the page, "3" in the upper left corner, and "1" in the upper right corner; the following page is numbered "2" in the upper center and "2" in the upper left corner, with the "2" in the upper left "X'd" out.] This Indenture made this seventeenth Day of September in the year of our Lord one Thousand seven Hundred ninety one between Thomas Payne Senior Executor & heir of Thomas Payne Deceased and William Payne John Payne Nancy Payne Nathaniel Payne Moses Payne Champness Payne Srorsbury Payne & Ruth Payne of Franklin County and State of Georgia of the one part and Leonard Malberry late of the town of Bedford and State aforesaid of the other part Witnesseth that the said Heirs of the said Deceased Thomas Payne for and in consideration of the sum of fifty Pounds lawfull Money of said State to us in hand paid by the said Leonard Malberry the Receipt whereof the said Heirs of the said Deceased Thomas Payne doth hereby acknowledge hath Given Granted Bargained & sold alineated and Confirmed unto the said Leonard Malberry all that Tract or parcel of Land lying and being in Franklin County on Toccoe Creek containing by estimation 287 1/2 acres and bounded as follows to witt on all sides by Vacant Land Courses are thus South 5 Deg West 40 chain to a Spanish oak corner thence South 85 Deg East 72 Chain to a white oake [Iee?] [Second page of the entry follows--apparently part of the deed including the rest of the legal description of the land was omitted by the clerk.] and also the Revertion and Reversions Remainders Right Interest Claim and demand whatsoever of us the said Heirs of the said deceased Thomas Payne of in and to that Tract or parcel of Land and premisses and every part thereof To have and to hold the said tract or parcel of Land and all and Singular the said premisses above mentioned with the appurtenances unto the said Leonard Malberry his Heirs and assigns forever to the only proper use and behoof of the said Leonard Malberry his Heirs and assigns forever and we the said Executor & heirs of the said deceased Thomas Payne for ourselves and our Heirs the said Tract of Land and premisses and every part thereof against us and our Heirs and against all and every Person or Persons whatsoever unto the said Leonard Malberry his heirs and assigns for ever shall and will Warrant & forever Defend In Witness whereof we the said Executor & heirs of the said Deceased Thomas Payne hath hereunto set our hands and Seals the Day & year first above written-- Signed sealed and ) his delivered in presence of ) Thomas T Payne (seal) The word, The, in Original mark Doc in the upper line William Payne (seal) interlined before assigned John Payne (seal) Nancy Payne (seal) Wm Hardin J.P.
