Whereas there was a Judgement obtained in the Inferior Court of said County against Leonard Marbury in favour of Thomas Payne, and fier facias issued on the twenty eighth day of November one thousand seven hundred ninety eight against said Marbury, & the same being executed was levied on the following tract of land (to wit) two hundred eighty seven & an half Acres of land in said County of Franklin lying on Toogaloe River known by the name of Eastatoa old fields, granted to said Leonard Marbury by his excellency S. Elbert, and was agreeable to Law advertised on the first Tuesday in February [left-hand page of folio 89] instant exposed to publick sale & the same was struck off to the said Thomas Payne for the sum of fifteen Dollars, said tract of land assertained By Courses & Distances as follows, Beginning at a Spanish oak corner on the River running thence South forty five West fifty chains to a red oak corner thence North thirty five West sixty one chains to a post oak corner on the said River bounded on the South West by Elijah Isaacs & on the North West by Vacant land at the time of Survey. Now this Indenture Witnesseth that the said Hezekiah Terrell hath for the sum aforesaid sold unto the said Thomas Payne all that tract or parcel of land aforesaid & the said Hezekiah Terrell as Sheriff for the County of Franklin sells & conveys unto him the said Thomas Payne & to his heirs & assigns forever the premisses before mentioned to have & to hold use occupy and enjoy In Witness Whereof the said Hezekiah [right-hand page of folio 89] Terrell Sheriff as aforesaid hath hereunto set his hand & affixed his seal the day & year first written Signed Sealed & Delivered ) H.
