This entry begins on the right-hand page of folio 129.] State of Georgia, This Indenture made this Eighth day of January in the year of our lord one thousand Eight hundred and Eleven Between Thomas Payne Ju'r and Milley his wife of the County of Franklin and State aforesaid of the one part, and Thomas Payne Sen'r of the County and State aforesaid of the other part. Witnesseth that the said Thomas Payne Ju'r and Milley his wife for and in consideration of the sum of one thousand dollars lawfull money of said State to him in hand paid by the said Thomas Payne Sen'r at or before the Sealing & delivering of these presents the receipt whereof is hereby acknowledged, Granted, Bargained, Sold released and confirmed; and by these presents doth Grant, Bargain Sell release and confirm unto the said Thomas Payne Sen'r his heirs and assigns all that tract or parcel of land containing three hundred and fifty acres situate lying and being in the county of Franklin and State aforesaid on the waters of Togalo River having such marks and forms as follows to wit Begining at a pine corner and runing South 64 East 14 [left-hand page of folio 130] chains to a white oak corner, thence North 75 East 29 to a Hickory corner, thence to a white oak corner on the East side of Payns Creek and along said Paynes old line, thence west 92 chains to a pine corner, thence North 49 chains to post oak corner thence North 40 West to the begining-- Together with all and singular the rights members and appurtenances thereof, whatsoever to the said tract of land Being Belonging or in any wise appertaining and the remainders reversions rights issues and profits thereof and of every part thereof to have and to hold the said tract of land and all and singular the premises and appertenances thereunto belonging as aforesaid and every part thereof unto the said Thomas Payne Sen'r his Heirs and assigns for ever to the only proper use Benefit and behoof of the said Thomas Payne Sen'r his Heirs and assigns for ever, and the said Thomas Payne Ju'r and Milley his wife for themselves and their heirs the tract of land and premises aforesaid and every part thereof unto the said Thomas Payne Sen'r his heirs and assigns against them the said Thomas Payne Ju'r and Milley his wife for themselves and their heirs and assigns shall and will warrant and for Ever defend the said Tract of land and premises by virtue of these presents; In Witness whereof the said Thomas Payne Ju'r and Milley his wife hath hereunto set their hands and seals the day and year first above written-- Signed sealed and delivered in presence of Zebediah Payne ) Thos.
