Will of Thomas Payne 17 Sep 1861 Franklin County, GA Georgia In the name of God Amen Franklin County I Thomas Payne now being sick but of sound mind and disposing memory ======= of property Knowing it is appointed once for man to die do make this my last Will and Testament ==== all others hertofore by me made Item 1st I disire after my death that my body be burried in as decent and Christian like manner as my circumstances will admit Item 2d I desire that all my just debts be paid Item 3d I desire that my Exucutor hereafter named to sell enough of my property to pay all of my just debts. and if any left to remain in the land wheron I now live for a home for my wife Mary and children until the youngest childs shall arrive a the age of twenty one years old and there to be sold and equally divided among my said wife Mary Payne and all my children each having an equal share except Alvan D. Payne. I have gave him our bay horse at the price of one hundred dollars I desire to be deducted from his part Item 4th I desire that Nacy M. Payne my wife Mary Payne & my son Thomas Reass Payne be my executors to carry out this my will In tistimony wherof I acknowledge this be by my will in ==== of W.J. Oliver his N.M. Watkins mark Georgia Before me came on the 17th day of September Franklin County 1861 at Chambers for the purpose of proving this last Will and Testament of Thomas Payne the witness to said will viz William J. Oliver Nacy M. Payne and Robert Watkens and the will having been before that time brought before me for probate by Nacy M. Payne one of the Executors the said witnesses depose of the same that they saw said Thomas Payne sign and publish the same as his las will on the day andyear it purports to have been executed by him that they witnessed the same at his request in his presence andin the presence of each other and the same was voluntarily executed by him while he was of sound and disposing mind and memory ====to and subscribed before me Sept. 17th 1861 Wm.
