This will entirely to itself, the edges worn away, probably part of the first book of wills which could not be found. Full copy. In the name of God, amen. I, Thomas Payne Junr. of Franklin County and the State of Georgia, being in perfect health of body and perfect min an memory, thanks be given unto God. Calling in to mind the mortality of my body, and knowing that it is appointed for all men once to die, do make this my last will and testament, that is to say principally and first of all, I recommend my soul into the hand of Almighty God who gave it, and as touching such worldly estates as vherewith it hath pleased God to bless me with in this life, I give, desire and dispose of in the following manner and form. First I give and bequeathe to my beloved brother Nathanial Payne one tract of land lying in said county and lying on Dosses Creek being the first creek that mouths in on the south side of the south fork of Broad river above the mulberry grove. Containing one hundred and fifty acres, the original grant in the name of William Payne. Secondly, I give and bequeathe to my beloved brother Moses Payne one tract of land in said county and lying in the south fork of Broad river being my first tract I hold on said south fork below Nathanial Payne’s own survey containing two hundred acres. Thirdly I give and bequeathe to my beloved brothers, Chanipness, Shreesberry (Shrewsberry), Zedediah, Poyndexter and Cleveland Payne and my sister Ruth Payne one tract of land, a piece. of some of my land to be as near the valley of the other tracts I have given my aforesaid brothers Nathanial and Moses Payne, and neither of my aforesaid brothers or sister to be vested with authority of making sail or of conveying the aforesaid lands and without the approbation of a majority of my executors hereafter mentioned and then the rest of my estate both "rail" and personal after my Lawful debts are paid to be disposed of as follows, that is to say the negro that Col. Benjamin Cleveland is owing me in case my beloved father should die before the death of my beloved mother, I give and bequeather unto my beloved mother, Yamaky Payne said negro dueing her life and after her deceast to be equally divided together with the rest of my estate between all my beloved brothers, step brothers and sisters and in case all of my brothers and sisters or either of their death without having an heir of his, her, or their body, that their part said estate shall be equally divided between the rest of my brothers and sisters and I do also hereby constitute and ordain my beloved father, and my friend John Gardram, Wm. Cawthon and Richards White my soul executors of this my last will and testament in witness whereof I have hereunto set my hand and seal this Fifteenth day of May, in the year of our Lord one thousand seven hundred and eighty six and in the tenth year of American independ-ency signed sealed and acknowledged in presence of us who in his presence and in presence of each other have hereunto subscribed our names.
