Will of John Payne 13 Apr 1833 Franklin County, GA JOHN PAYNE'S WILL (Son of our William b: 1752 m: Catherine)? Georgia Franklin County In the name of God. Amen I, John Payne Snr of the County and State aforesaid, being sick but of sound mind & memory, thanks be to God Calling in mind the mortality of my body and Knowing it is appointed for all men once to die, do make & ordain this my last will & testament, that is to say, principally and first of all , I give and recommend my soul unto the hands of Almighty God that gave it, and my body I recommend to the earth to be buried in decent Christian like burial, at the discretion of my Executors, nothing doubting, but that I shall receive it again by the mighty power of God, and as touching such worldly estate as it has pleased God to bless me with in this life, I give Devise, and dispose of in the following manner and form: First of all I give and bequeath to my dearly beloved wife Polly Payne the whole of my estate, both real and personal to be by her peaceably enjoyed during her natural life, or widowhood, but if she marries , then to take a childs part and the balance to be equally divided between all my Children, except Charles L M Payne, who may have the sum of one dollar to his part, and I hereby utterly disannul, revoke, and disallow all other and every other former testament, will or bequest by me in any wise before made, willed or bequeathed, ratifying & Confirming this to be my last will and testament.
