Will of Nancy Payne 12 Aug 1858 Franklin County, GA Nancy Elizabeth Payne's Will dtr. of David Henslee Georgia ) In the name of God-amen, I Nancy Payne of the Franklin County ) County and State aforesaid being in bad health, and of Sound mind and disposing memory, but knowing I have to die do make, ordain & publish this my last Will and Testament, 1st of all I give my Soul to God who give it, and body to a decent Christian-like burial at the discretion of my Executers hereinafter named, 2nd It is my will that all my Just debts be paid as soon after my death as is practiable, 3rd I give and bequeath unto my Mother Mary Payne whom I dearly Love all the property that I may die possessed of both real and personal, during her natural lfe, and after her death it is my desire that all my property both Real & personal should be equally divided between all my brothers & Sisters, Including David Wacaster with the exception of Elvira Shackellord to whom I give five dallars for her part the balance of my brothers and Sisters (to wit) Jackson C Payne, John E Payne, Martha H Payne, Jess M Payne, Josiah R Payne, David H Payne, Rhoda Chatham, Sarah E Carson, David Wacaster, Moses P Payne to have an equal portion of all my property with the exception to two feather beds and furniture, which I give one to my Sister Rhoda Chatham, the other to my Niece Mary E Wacaster, 4th I do hereby nominate, constitute and appoint Josiah R Payne and David H Payne Executors to this my last Will and testament, hereby revoking all former wills by me made.
