Will of Ann Payne 15 Feb 1833 Franklin County, GA Ann Payne's will Redbank's Wife In the name of God Amen- I Ann Payne Senior ot the State of Georgia and County of Franklin, being old and Considerably enfeebled in Body, but of sound mind & disposing memory. Calling to mind the mortality of my Body, & Knowing that it is appointed for all once to die, do make and ordain this my last will and Testament- That is to say, principally and first of all, I give and recommend my soul to Almighty God who gave it, and my body recommend to Earth, to be buried in decent Christian Burial at the discretion of Executors--And as touching my interest in the present lottery, if it should be my fortune to draw either Gold or land or both, I give and dispose of the same in the following manner & form. First it is my will and desire, if I should be a fortunate drawer in the present lottery, that there should be an equal distribution of the same amongst my Seven Children or their representatives in the following manner- To my Eldest son Maxfield H Payne one seventh part , to my Eldest daughter Elizabeth Payne one seventh part, to my son Thomas Payne one seventh part, to my third son David Payne one seventh part- To my second daughter Nancy Bennett one seventh part during her life, and at her death to be equally divided amongst her own born Children. To my grand Children the Children of my daughter Polly Chathan one seventh part- To my grand Children the Children of my daughter Ruthy Chathan one seventh part. And it is my desire that if there should be anything to distribute amongst the above named Legaties, that what is coming to my Daughters Polly & Ruthy's Children should remain in the hands of my Executors and paid out to then as they comes of age to receive it, I do hereby Constitte and ordain Maxfield H Payne, Thomas Payne, and David Payne, my first second and third sons, Executors of this my last will and Testament.
