Court Of Ordinary (fulton County) Will Books, 1854-1924 Written: May 25, 1908 Recorded: June 1, 1914 Georgia, Fulton County, I, J. H. Harwell, being of sound and disposing mind and memory, do make, declare and publish this my last will and testament, hereby revoking any will by me at any time heretofore made. Item I. Upon my death, it is my wish that all my debts be paid in the manner and out of the property as in hereafter set forth, and that my body be given Christian burial in a manner befitting my station in life, in the lot which I now own in West View Cemetery. Item II. I will that the following described property be sold at private or public sale by my Executors within one year from the time of my death, to wit; All that tract of land in Land Lot Two Hundred and Sixty in the 14th District of said County, containing eighty acres, more or less, commencing 11 30/100 chains South of the Northwest corner of said Land Lot, and running South along the original line to the Southwest corner of said lot; thence North through the center of said lot to the North line of said lot; thence Southwesternly to the beginning point, except seven acres, more or less, previously sold off to George Green from the East side of the West half of said lot Two Hundred and Sixty. (260) Also the following tract of land in said Land Lot and District, to wit; Beginning at a rock corner between land owned by Isaiah Higgins, George Lyons, and John H. Harwell; thence running South along the East line of John H. Harwell's land, Six Hundred and Eighty feet; thence East Two Hundred and Fifty feet; thence North Six Hundred and Eighty feet; thence West Two Hundred and Fifty feet to the beginning point, containing Four acres, more or less. Also the following tract of land in said Land Lot and District, to wit; Bounded on the North by land of Chas. E. Turner, on the East by land of Samuel Wilson; on South by lands of Higgins and Wilson; on West by lands of J.H.Harwell, being intersected by Mason & Turner's Ferry Road, containing One acre. Also tract of land in said Land Lot and District, as follows, to wit; Ninety feet front on Mason & Turner's Ferry Road, running back same width to Hall's line, containing one-half acre, more or less, Bounded West by Harwell; North by Mason & Turner's Ferry Road; East by Higgins; South by Hall. The foregoing several tracts being all of the property I own in said Land Lot Two Hundred and Sixty (260) in 14th District of said County. The proceeds from the sale of all said property to be divided share and share alike, between my two daughters, Julia E. Harwell Head, and Lizzie May Harwell Haynie. Upon the death of either of said daughters without child, the share of such deceased daughter is devised to the surviving daughter. Upon the death of the other said daughter without child said property shall go to my sons Wm. T. Harwell, and Walter E. Harwell, share and share alike, Upon the death of either of said sons without a surviving child, the interest of said son is devised to the surviving son. Item III. I give bequeath and devise to my wife, Sarah E. Harwell the following described property, to wit: Policy of insurance or benefit certificate for Four Thousand Dollars, issued by the National Union, which said certificate or policy is now, by its terms, payable to my said wife. Also all household goods and kitchen furniture, money, notes, accounts, and all personalty of which I may die possessed, and all property not otherwise herein specifically devised. Item IV. I give, bequeath and devise unto my wife the following described property, to wit: Tract of land beginning one hundred and eighty- four (184) feet West from the Southwest corner of West Hunter and Jeptha Streets in the City of Atlanta; running thence West along the South side West Hunter Street two hundred and fourteen (214) feet, and extending back South even width with front Two Hundred and Twenty-Four (224) feet to a ten (10) foot Alley. Also two lots in Highland Cemetery, known as lots Seventy-five and Seventy-six (75 & 76) in Block 5 in Land Lot Two Hundred and Forty-seven (247) in the 17th District of said County, for and during her natural life, and at her death, it is my will that said property be sold by my Executors, or either of them, at public or private sale, without order of Court or legal advertisement, and the proceeds be divided among my children, Wm. T. Harwell, Walter E. Harwell, Julia E. Harwell Head, and Lizzie May Harwell Haynie, share and share alike. Should either of my children die without child before said legacy is paid over to them by my executors, the legacy is to be paid the survivors, share and share alike, Should either die with child, said child, or children to stand in the place of the deceased parent. Item V. It is my will that my executors pay all of my debts and the debts of my estate out of the legacies and devises which I have hereinbefore given and devised to my said wife. My executors shall have the power and they are hereby authorized to sell at public or private sale, or to borrow money upon the security of property, if the same is necessary to pay my debts. Item VI. I give, bequeath and devise unto my son, Walter E. Harwell, Cemetery Lot 209, Section 2, in West View Cemetery, for family burying ground. Item VII. I constitute and appoint my son, Walter E. Harwell, and S. A. Williams, as Executors of this will. It is my wish that they be required to file appraisement of my property to the Ordinary, but that no returns be made to him thereafter, and that they be not required to give bond. John H.
