FULTON COUNTY GA Will - Head, Harriet Henrietta File contributed for use in USGenWeb Archives by Barbara Winge barbarawinge@yahoo.com http://files.usgwarchives.net/ga/fulton/wills/head.txt GEORGIA, FULTON COUNTY I, HARRIET HENRIETTA HEAD, of said state and county, being of sound mind and disposing memory, do make this my last will and testament, hereby revoking and annulling all other wills heretofore made by me. ITEM I I desire and direct that my remains be place in a good casket and interred in the Strickland lot in the cemetery at Griffin, Georgia, beside sister, Emily Head Strickland. ITEM II I desire and direct that all my just debts, including the expense of my last sickness and funeral, be paid by my executor herein after named and appointed, as soon as practicable after my death. ITEM III I give, devise and bequeath to my great-niece, Mrs. Murray Gundy of Enid, Oklahoma, the sum of One Hundred Fifty ($150.00) Dollars in cash. ITEM IV I give, devise and bequeath to my great-niece, Mrs. Henrietta Doremus of Enid, Oklahoma, the sum of One Hundred fifty ($150.00) Dollars in cash. ITEM V I give, devise and bequeath to Alice Walker Stancil eleven (11) hand-painted plates and one hand-painted platter to have and to hold during her natural life, and at her death, the same shall go to and become the property of her brother, Konts Walker. ITEM VI I hereby give, devise and bequeath to Mr. and Mrs. Frank B. Davenport the sum of Five Hundred ($500.00) Dollars in cash, provided neither one of them files any claim of any kind or character against my estate for rent, board, or any other claim. In the event any claim is filed by either one of said parties against my estate, then said $500.00 shall automatically become a part of the residue of my estate and be disposed of as provided in Item Ten (X) of this my last will and testament. ITEM VII I desire and hereby direct that my executor hereinafter named and appointed sell all my books, furniture, china, silverware, pictures (except family portraits), piano, bar pin, diamond rings, and that the cash derived from the sale of same be used to apply on the above specified bequests. (My bar pin and diamond rings are in my safety box in the First National Bank of Atlanta, and the remainder of items named herein are stored at the home of Mr. and Mrs. Frank B. Davenport, 647 Linwood Avenue, N. E., Atlanta, Georgia). ITEM VIII If there are not sufficient funds in my estate, after converting all of my property into cash, to pay my debts and to pay the above specified bequests, I hereby direct that my executor hereinafter named and appointed, pay my debts, and then prorate the balance among the above named beneficiaries. The proration made by my executor hereinafter named and appointed shall be final and binding upon all of said beneficiaries. ITEM XIX (SIC) i give, devise and bequeath to my niece, Miss Nancy Head, and my nephew, James P. Head, my undivided one-third (1/3) interest in and to the Riverside Plantation located in Butts County, Georgia, share and share alike. ITEM X I hereby give, devise and bequeath all the remainder and resideu of my estate, both personal and real and whereever situated, to the Martha Ivey Nursing Home, now located at 809 Myrtle Steet, N. E., Atlanta, Georgia, same to be used only for the purpose of maintenance and upkeep of one room in memory of Harriet Henrietta Head. ITEM XI I hereby nominate, constitute and appoint my friend, Thomas Howell Scott, as executor of this my last will and testament, and I hereby give him full power and authority, as such executor, to sell any of all of my estate, both personal and real, at public or private sale, and without any order of court. It is my desire, however, that my said executor give a good and sufficient bond in the sum of Three Thousand ($3,000.00) Dollars, and that my estate be wound up within one year after my death. IN WITNESS WHEREOF I have hereunto set my hand and affixed my seal this 23 day of September, 1942.
