Item First: I desire and direct that all my just debts be paid without delay by my Executors herein after mentioned and appointed as I am unwilling that my creditors should be delayed in their rights, especially as there is no necessity for delay. Item Second: I give and bequeath to my daughter Amanda Katherine Houston wife of W J Houston and all of her children free from the disposition of her present or any future husband, my negro girl named Sarah Elizabeth about nine years old. Item Third: I give and bequeath to my daughter Mary Jane Elizabeth Powell my negro girl named Marinda Narcissa Haseltine about seven years old for her sole and separte use and children if any she should have - free from the liabilities or disposition of her husband if she should hereafter marry. Item Fourth: It is my will and desire that the residue of my property both real and personal shall be equally divided or sold as may be thought best between all my children to wit: William A., James O., John J. Leonard C., George Washington Lindsey Powell, Martha Ann Jincie Powell wife of Fielding Travis Powell, Amanda Katherine Houston wife of W J Houston and Mary Jane Elizabeth Powell and if it should be thought best that the residue of my estate not especially bequeathed should be sold it is my will and desire that the proceeds shall be so dividied as to make each share equal including the value of the two negro girls bequeathed in item second and third to Amanda Katherine Houston wife of W J Houston and Mary Jane Elizabeth Powell and five hundred dollars in money heretofore advanced to Martha Jane Jincie Powell wife of Fielding Travis Powell and it is distinctly my will and desire that the several amounts heretofore give to my daughters or value of the property bequeathed to them shall be deducted from their portion of my Estate so as to make each child receive the same amount. Item Fifth: It is my will and desire that the several amounts of money or property which each of my daughters may receive shall be for their sole and separate use and benefits and their children and free from the liabilities, debts or contracts of either of their present or future husbands. Item Six: It is my will and desire that in case either of my said daughters should depart this life without having any children that the portion of property bequeathed to said daughter or amount of money or property she may receive as her share of my estate then and in that case is to revert to my Estate and be disposed of as set forth in the fourth item in my will. Item Seventh: I hereby appoint and constitute my three sons, To wit: William A., James O., and John J. Powell Executors of this my last will and testament this 23rd day of June 1857. State of Georgia} County of DeKalb} Whereas I Chapmon Powell have this day the same being the twenty third day of June in the year eighteen hundred and fifty seven signed sealed declared and published my last will and testament in presence of W M Hill, J R McAlister and T W J Hill who signed said will and testament as witnesses whereas I am desirous of making an additional item to said will therefore make and publish this codicil to my said will. Item First: It is my will and desire that my executors heretofore mentioned in my will shall pay to Mary Jane Elizabeth Powell my daughter and my son George Washington Lindsey Powell the sum of one hundred and fifteen dollars each out of my estate previous to any division and the said amounts are not to be reckoned in said division as set forth in the fourth item of my will this 23rd day of June 1857.
