Foster Town Lots Nos 33 & 34 GEORGIA, GILMER COUNTY. This indenture made and entered into this the Twelfth day of Jan in the year of our Lord Eighteen Hundred and forty seven between Benjamin Johnston and James G. Gudger of the one part and Newton M. Foster of the other part, both of the county and state aforesaid. Witnesseth that the said Benjamin and James G. for and in consideration of the sum of one hundred dollars to themselves paid by the said Newton Foster at and before the sealing and delivery of these presence the receipt whereof is hereby acknowledged, hath granted, bargained and sold, and by these presents do hereby bargain, sell and convey unto him the said Newton M. Foster, his heirs and assigns. All of two certain lots or parcels of land, situate, lying and being in the second survey of the Town of Ellijay in Gilmer County, State of Georgia known and distinguished in the plans of said town and survey by lots numbers thirty three 33 and thirty four 34. To have and to hold the said bargained lots of land unto him the said Newton M. Foster his heirs and assigns together with all and singular their rights, members and appurtenances thereof to the same in any manner belonging to his and their assigns proper use benefit and behoof forever in fee simple and the said Benjamin Johnston and James G. Gudger for themselves, their heirs, executors and assigns will warrant and forever defend the title of said lots unto the said Newton M. Foster his heirs and assigns against themselves and against the claims of all other persons whatsoever claiming the same. In Witness whereof the said Benjamin Johnston and James G.
