M. Foster Deed To J. P. Alexander No. 62 & 63- 11 State of Georgia, Gilmer County, this indenture made this Eighth day of May in the year of our Lord Eighteen hundred fifty two between Newton M. Foster of the County and State aforesaid of the one part, and John P. Alexander of the same place of the other part. Witnesseth that the said Newton M. Foster for and in consideration of the sum of Eleven Hundred Dollars to him in hand paid at and before the sealing and delivery of these presents the receipt whereof is hereby acknowledged hath granted bargained sold and conveyed and does by these presents grant bargain sell and convey unto the said John P. Alexander his heirs and assigns, all that tract or parcel of land situate lying and being in the County of Gilmer ______ in the plan of survey by parts of (No. 62 & 63) numbers sixty two and sixty three of the Eleventh district and second section of originally Cherokee now Gilmer County bounded as follows: to wit: number sixty two as aforesaid commencing at a poplar tree at the Bridge on the Ellijay River through the lane to the corner of the lot sold to John W. Johnson thence back with his line eighteen and a half rods, thence with the line of Young & Martin’s lots to the big road or Cassville Road, thence running along the road to the line of number sixty three, as aforesaid, thence with the line of number sixty three to the Ellijay River thence up the said river to the beginning. And number sixty three as follows viz: commencing at the Southeast corner of said Lot near the Ellijay River, thence North Eighty Rods thence running due west to the Western boundary line of said lot, thence Eighty poles to the corner thence East one hundred and sixty poles to the beginning reserving three acres more or less, around the Ellijay Academy in the last mentioned boundary both boundaries containing one hundred acres more or less. To have and to hold said parcels of land until him the said John P. Alexander his heirs and assigns together with all and singular the right members and appearances thereof to the same in any manner belonging to him and their own proper use benefit and behoof forever in fee simple. And that the said Foster for himself his heirs executors and administrators the said bargained premises unto the said Alexander his heirs and assigns will warrant and forever defend the right and title thereof against themselves and against the claim of all other persons whatever.
