H. Gudger To E. T. Short & D. D. Nicholas OPTION: STATE OF GEORGIA. Know all here by these presents that in consideration of the sum of one dollar to me in hand paid by E. T. Short and D. D. Nicholas of Knoxville, Tennessee, the receipt of which is hereby acknowledged, I have given and granted and do hereby give and grant to said E. T. Short and D. D. Nicholas or their assigns the right to purchase at any time within twelve months from the date hereof and upon the terms herein set forth the property described as follows to wit: All of lot no 28 in 10th Dist 3rd Section in Gilmer County, Georgia containing 160 acres of land more or less. The said E. T. Short & D. D. Nicholas are to have the right to prospect for minerals on said land during the time this option is in force at the price of one thousand ($1000) dollars to be paid in lawful money and for the consideration alone said I hereby covenant and agree to and with said E. T. Short and D. D. Nicholas and their assigns that if he or they "fault"(????) at any time within 12 months from the date hereof elect to purchase said property under this option I will make to him or them or to any person or persons whom they may appoint or designate for that purpose a good and sufficient warrantee deed for said premises upon compliance by said E.
