Warranty Deed STATE OF GEORGIA, Gilmer County, THIS INDENTURE made the Fifteenth day of September in the year of our Lord One Thousand Nine Hundred and Ten between W. H. Foster of the County of Gilmer and the State of Georgia of the first part, and The Town of East Ellijay of the County of Gilmer and the State of Georgia of the second part, Witnesseth: That the said party of the first part does for and in consideration of the sum of Twenty-five Dollars in hand paid at or before the sealing and delivery of these presents, the receipt whereof is hereby acknowledged, has granted, bargained, sold, aliened, conveyed, and confirmed, and by these presents do so grant, bargain, sell, alien, convey, and confirm unto the said party of the second part its successors and assigns, all of the following tract or parcel of land lying and being in the Eleventh District and second section in said county being a part of original land lot No (97) ninety-seven and being in the town of East Ellijay more fully defined as follows: beginning at the northeast corner of W. Patterson property in said town thence running along the line of said property south 430 feet thence east 38 ft. thence north 30 ft thence north 98 ft to the beginning point. Containing one acre more or less. This property is conveyed to said town for a street and is never to be closed or used for any other purpose. TO HAVE AND TO HOLD the said bargained premises, with all and singular the rights, members, and appurtenances thereto appertaining, to the proper use, benefit, and behoof of The Town of East Ellijay the said party of the second part its successors, executors, administrators, and assigns, in fee simple. And the said party of the first part W. H. Foster the said bargained premises unto the said party of the second part its successors, executors, administrators, and assigns, and against the said party of the first part his heirs, executors, administrators, and against all and every other person or persons, shall and will warrant and forever defend, by virtue of these presents. IN WITNESS WHEREOF, the said party of the first part has hereunto set his hand and affixed his seal, and delivered these presents, the day and year first above written.
