A copy of the handwritten will is found in the Georgia State Archives under "Georgia's Virtual Vault." Capt. Philip Delegal resided at one time in the Province of South Carolina. He and his son Lieutenant Philip Delegal, Jr. assisted General James Edward Oglethorpe who found and settled Savannah, GA. He also was involved in defence against the Spanish on St. Simon's Island, Georgia at Fort Frederica. Fort Delegal on St. Simon's Island was named for him. By the Tenor of these Presents, We Elias Crespin Vice dean of the Island of Guernsey, do Make known unto all Men That on the thirty first Day of the Month of December one thousand seven hundred and Sixty two, The last Will and Testament under written was proved upon the oath of Mafs. Andrew Miqualt & Edward Knight that it was read to Philip Delegal, Esq The Testator, The Day it was Signed, and that they saw him Sign and Seal it as his last Will & Testament, and that they signed as Witnessess thereunto at his Request, and that all the Time he was of a Sound and disposing Mind and Memory which last Will and Testament is as followeth. In the name of God Amen. I Philip Delegal, Esq. dwelling in the Parish of Saint Peters Port, in the Island of Guernsey, Captain of a Company for the honourable Lieutenant General Parsons Regiment of Invalids at the time of the Sealing and Publishing hereof, guartered in the aforesaid Island of Guernsey. Being weak and infirm of body, But of perfect and sound, disposing Mind and Memory, Blessed be the Almighty, therefore Seriously reflecting and ruminating on the Certainty of Death, joined with the uncertainty of the hour of its approach and as much as in me lays?, to prevent all Manner of discord in my family, after my decease. Do. make, publish and declare this my last will and Testament in Manner and form following, that is to say. Principally and first of all, I give and recommend my Imortal Part into the hand of my great Creator hoping for Remision of my Misdeeds in this Sinful State Committed through the merits of my Redeemer Jesus Christ, God blessed forever My Body I Bequeath unto the Earth, from Whence it came to be buried in a Decent and Gentleman like manner at the discretion of Those my trustee herein after named not in the least doubting but at the General audit, on the last Day I Shall receive the same again, by the Mighty Power of God, and as to what Worldly goods Chattels or Estate, it shall or may please God to bless me with I give devise and bequeath the same in manner and form following. First I give and bequeath unto my dear and Well beloved Wife, Eleanor Delegal, living at Philips Bluff, in the Province of South Carolina in case She Survives me over and and above her Plantation Situate at Philips Bluff aforesaid, which I hereto fore by firm deed of gift transferred to my said Wife. my son Edward and Daughter Sophia Interested Parties in conjunction in said deed the further Sum of Two Hundred Pounds, purchased by me in the Consolated Funds of three per Cent annuities, tranferable at the Bank of England, on the twenty Second day of april in the year one thousand seven hundred and Sixty one, as by receipt of that date, Signed John Sauce amongst others of like Nature among at my Papers being will or may found to be by her enjoyed without any condition, limitation use or Trust whatever, during the Course of her natural life and at her decease if any part thereof be remaining, to be disposed of in such manner amongest her Children or Grand Children, as she shall or may think proper, But in case my said Dear wife should not Survive me, then my will is, that the said two hundred Pound Bank Stock, shall devolve and falls unto my daughter Catherine, the wife of Wm. Hugh Campbell, of the foresaid Province of South Carolina. Mariner, and in case of her decease happeining before mine then to the legal Heirs born of her Body or the Survivors of them, equally to be divided amongst them, Share and Share alike. Item I give and bequeath unto my Eldest son, Philip Delegal of Little Ogechee, in the Colony of Georgia Gent:, the sum of Hundred Pound Bank Stock, purchased by me in the Consolidated funds of three per Cent annuitiees, transferable at the Bank. of England as per Recepit for the same bearing date the sixth day of June, one Thousand seven Hundred and sixty and Signed her? Simons which amomgst my other Papers of like Nature, will or may be found as also I give and further bequeath unto my said son Philip, my Gold Watch, Swords, Plate Jewels, Linnen and wearing apparel, which at the Time of my decease, I shall may be possessed of But in case my said Son Shall not be living at the time of my decease, Then my will is, that all and singlar the aforesaid Legacies shall be equally divided amongst the children of my said Son. Philip, share and Share alike. Item. I give and bequeath unto my son John Delegal, of the aforesaid Province of South Carolina, Mariner, the like sum of two hundred Pounds Bank Stock purchased by me on the Second day of March, one thousand seven hundred & fifty eight in the said fund of three per Cent annuities, transferable as herein before exprest, as by receipt remaining among my other Papers of like nature and signed by Wm. Catesford. will upon examination appear or to him? Lawfully begotton Children if my said Son die before me, equally to be divided amongst them or the Survivors of them, share and share alike. Item. I give devise and bequeath unto my two Sons, George and Edward Delegal dwelling in the aforesaid Province of Georgia Planters, all that my tract of Land laying and being situate near unto? the Lands of my eldest Son Philip at little Ogechee, in said Province containing five Hundred acres more or less, and for which a Grant ??? in my and my aforesaid Wife Eleanors name, Sometime since is obtained of the proper officers or Trustees of said Province, to be equally divided Between them or the surviving Heir at law of either of them, and so to remain and devolve from their Respective Heir to Heir, in firm Intact for ever, And I further more give and bequeath unto my said Son George the sum of one Hundred pounds, Stock in the aforesaid fund which was purchased therein by me the Testaor on August the fourth day, in the year one thousand seven hundred and fifty eight as will appear amongest my other Receipts and is signed Mary Anne Dewaux and to hislegal Heirs, in case of his decease before Mine. Item. I give and bequeath unto my aforesaid Son, Edward Delegal in case he survive me. the like sum of one hundred Pounds, Stock aforesaid, which was purchased by me in the before mentioned fund of three per Cent annuities, transferable as aforesaid on the twenty seventh day of August one thousand seven hundred and sixtyas by the Receipt for the same signed James Scott, amongst my other Papers deposited, will or may appear and in case my said Son doth not Survive me, then my will in, that, the said one hundred Pounds shall be equally divided amongst the Children of my Said Son Edward or the Survivors them share and Share alike. Item. I give and bequeath unto my eldest daughter Catherine herein before mentioned, over and above the Reversion of the aforesaid two hundred Pounds begueathed nto my dear Wife Eleanor, the further sum of one hundred Pounds, Stock in the before mentioned three per Cent annuities, purchased by me there on december thirtieth, in the year one thousand seven hundred and Sixty. as will appear by Receipt of that date signed Anthony? Malpras? amongst my other papers, being and in case my said daugher Catherine doth not survive me, then the said one hundred Pound my will is, Shall be divided amongest the Survigning Children my said daughter, equally share and share alike. Item. I give and bequeath unto my daughter Margaret, Wife of ----------- of the aforesaid Province of South Carolina, planter, the sum? one hundred Pounds stock, purchased by me in said funds on the fourteenth day of october one thousand seven hunndred and sixty one, as by receipt of that date, Signed Thomas Littleburry, amongst my other Papers will be found: But in case my said daughter Margaret shall not survive me, then my will is that the said one hundred Pounds be equally divided amongst the surviving Children of said daughter share and share alike. Item. I give and bequeath unto my youngest daughter, Sophia, some time since living with her mother; in the aforesaid province of South Carolina, the like sum of one hundred Pounds Stock, in the funds aforesaid, Purchased therein by me on the eleventh day of April, in the year one thousand seven hundred and fifty eight as per Recipt bearing like date, and Signed Wm. Crawford, to be found amongst my other papers, Shall and will appear, but in case she? both doth survive me, then my will is, that the said one hundred Pounds be equally divided amongst the surviving Children if any such thereby of my said daughter share and share alike. Item. I give and bequeath unto the Poor, of the aforesaid Parish of St. Peters Port, in the said Island of guernsey the sum of ten Shillings, to be paid within six months after my decease to the Proper officers of said Parish, for the use of the said Poor. as to all the rest, Residue and remainder of my estate both Real and personal of what soever nature kine or property, the same may bear Comsist of my will is that immediately after my Interment, soon as conveniently may be done. The same may Be sold and after my just and legal debts and funeral expences shall be well and truely paid and satisfied, the produce be disposed, divided and given as followeth, Namely one fourth part unto my dear wife Eleanor foresaid, one half thereof unto my eldest Son Philip, and the other remaining fourth part, amongst my other six Children or their lawful heirs, share and share alike. and further my will is, that in case any of my before named Children should die leaving no legal issue behind them, that the? Part of him or them so dying and there Interests in this my will bequeathed, Shall be equally divided between my surviving Children or their Heirs equally, share and share alike. and lastly I do hereby ordain, constitute & appoint my aforesaid wife Eleanor and my aforesaid son Philip, joint executor and executrix of this my last will and testament, But in case they or either of them Should not survive me & then my Sons Edward and George aforesaid or the Survivor of the two shall become joint executors with the Survivor of my two first named executors and executrix, as the same may happen and fo? the Executorship to desend in case of Death to the next eldest of my sons, who shall or may be living at the time of my decease. But whereas my said Children are all dwellers beyond the seas, in the aforesaid Province of South Carolina and Georgia, and thereby rendered incapable of taking immediate care of my Effects in Great Britain or Guernsey, in order therefore do prevent anything happening contrary to the Intention and Purpose of this my will I do hereby Nominate, ordedain and appoint my trusty and esteemed Friends, the honourable Sir John Mylne, Barrond Lieutenant governor of guernsey aforesaid and Ellsha Tupper of said Island joint trustees or agents after my decease to act transact sell and transfer or other wise dispose of to the best advantage for the benefit of the several legaties before named and the true intent and meaning of this my will, al and singular my sundry affects household goods, and other an also to take into their Charge and custody all deeds writtings and papers which I shall or maybe possessed of at the time of my decease, and to correspond with my aforesaid Executors in North America, and act in all things they shall find meat and Requsite, to answer the purpose of my will and the trust reposed in them t which two last named Trustees I give and bequeath the sum of one guinea, to each of them to buy a mourning Ring, as a token of Remembrance of me, hereby utterly Revoking disannulling and making void all and every other wills or testaments by me at any time heretofore made, published or declared, publisheing and declaring this and no other, to be my last will and Testament In witness whereof I have hereunto set my hand and seal. In the Island of guernsey aforesaid, this twenty second day of January in the Second year of the reign of our most gracious sovereign Lord, George the third by the grace of God of Great Britain, france and Ireland. King defender of the faith and so fourth and in the year of our Lord one thousand seven hundred and sixty two.
