I Daniel Touchstone of Green Creek in the County of Glynn Planter, being weak in body but of sound mind and perfect recollection do make this my last will and Testament in manner and form following. Vis-- Imprimis I recommend my soul to God who gave it, and give my Body to the Earth, to buried [sic] in such manner as my Executors may deem proper, the expenses whereof I hereby order to be paid out of any monies belonging to my Estate. Item I give and bequeath unto my dearly beloved wife Annis Touchstone and to my children: Rebecca, Lewthany[?], and Catherine and to their heirs forever, all my Estate personal to be divided among them share and share alike (except as is hereinafter excepted) and whereas my said wife Annis is now in a state of Pregnancy if it should happen that the child whereof she is now quick [?] should be born alive it is my intention and I hereby expressly declare it to be my will that the said child should have and possess its equal proportion of my Estate with my said wife Annis and my other aforementioned children anything herein contained to the contrary notwithstanding. Item I give and bequeath unto Stephen Brook as soon as he should have become of Legal age the amount of fifty acres of land to be taken from the proceeds of the sales of my Real Estate at and after the rate which the whole may sell for. Item it is my will and intention that all my real Estate and stock of meat cattle, Horses, and Hogs should be sold by Executors hereinafter mentioned as soon as circumstances in their opinion shall warrant it, such as schooling of the children, purchasing negroes, lands, etc. And lastly I do hereby nominate, constitute and appoint my aforesaid beloved wife Annis Touchstone my executor and my trusty and well beloved friends John Franklin and Thomas Waters my Executors. Declaring this to be my last will and testament and revoking all others by me heretofore made. In witness whereof I have hereunto set my hand and seal this fifteenth day of November in the year of our Lord one thousand eight hundred and nine.
