Warranty Deed - "Trustees of Mercer University" to "Geer"

The State of Georgia.
     This indenture, made this thirteenth day of January in the year of our 
Lord One Thousand Eight Hundred and Seventy three between The Trustees of 
Mercer University of the County of Bibb of the one part, and J. F. Gier [sic] 
of the County of Greene of the other part.
     Witnesseth, That the said parties of the first part for and in 
consideration of the sum of Fifty Seven Dollars, in hand paid, at and before 
the sealing and delivery of these presents, the receipt whereof is hereby 
acknowledged, have granted, bargained, sold and conveyed, and by these 
presents do hereby grant, bargain, sell, and convey unto the said J. F. Gier 
[sic], his heirs and assigns, all that Tract or Parcel of Land situated, lying 
and being in Greene County in or near the town of Penfield, know by the No. 
(8) eight, containing (4 3/4) acres, four and three quarter acres. according 
to a recent survey & plat made by John G. Holtzclaw.
     To Have and to Hold the said lot of land with all and singular the 
rights, members and appurtenances thereof, to the same being, belonging, or in 
anwise appertaining, to the only proper use, benefit and behoof of him, the 
said J. F. Gier [sic] his heirs, executors administrators, and assigns, in Fee 
Simple; and the said parties of the first part & their successors in office 
the said lot of land unto the said J. F. Gier [sic], his heirs, executors, 
administrators and assigns, against the said parties of the first part & other 
person or persons, shall and will warrant and forever defen, by virtur of 
these presents.
     In Witness thereof, The said parties of the first part have hereunto set 
their hands and affixed their seal, the day and year first above written.

     I accept the within title upon the condition that I will not sell or 
allow others to do so any intoxicating liquors upon the premises.  Given under 
my hand and seal this 25th day of January, 1873
