I Stephen Bishop Farmer of the State of Georgia and County of Greene being of sound mind and memory but recollecting the certainty of death do make and ordain this my last Will and Testament. It is my will and desire that my body be buried in a decent and Christian like manner and as it respects such wordly Estate as it hath pleased God to bless me with in this life I divide and dispose of the same in the following manner & form viz First It is my will and desire that all my just debts and fauneral expenses be paid. Item 2nd It is my will and desire and I do will and bequeath unto my daughter Lydia Noble ONe half of the land and premises whereon I now live either sale or divided as it is hereafter described and in case of sale one half of the proceeds thereof to the said Lydia Noble in(?) fee simple and her heirs too. Itme 3rd It is my will and desire and I do hereby give and bequeath the to the orphans and children of James Bishop decd (viz) Wilson S. Bishop, Polly H. Bishop, Venifry(?) C(?) Bishop, Brice H. Bishop and Benel Bishop the ot her half of the land and premises whereon I now live to be equally divided among said orphan children; but provided they disagree in dividing the land then and it that case it is further my will and desire that the land be sold at the discretion of my Executors and the proceeds divided equally as above stated in addition to toher property heretofore given. Item 4th It is my will and desire and I do herby give and bequeath to my son Asa Bishop a Tract or lott of land drawn by Fanny Bishop in Wilkeson County when drawn. Also I further bequeath to Asa Bishop one negro Boy named Bow Tucks about eighteen years old, one desk, one clock & case, one Bed, furniture and bedstead and one set of Blacksmiths Tools in fee simple in addition ot other property heretofore given. Item 5th It is my will and desire and I do give and bequeath to my daughter Ruth Newton the use of two negroes Zingo & Sinth his wife during her natural life and after her death to be equally divided among her childrfen in addition to other property heretofore given. Item 6th It is my will and desire and I do give and bequeath to my Executors herein after to be named one negro girl Roda and her increase to be applied to the use of my daughter Sally Briggs during her natural life *and after her death the said Roda with her increase to be equally divided among all my children and their legal representatives. I also will and desire Sally Briggs Three(?) Hundred and Twenty Dollars due use(?) by John Bishop and Willis Newton in addition to other property heretofore given. Item 7th It is my will and desire and I do hereby give and bequeath to myt daughter Mary Hagerty the use of two negro girls namely Pallis(?) & Sucky during her life and then to be equally divided among Mary Hagertys children in addition to other property heretofore given. Item 8th It is my will and desire and I do herby give and bequeath to my Executors hereafter to be named Seven negroes (viz) Jim Punch and his wife, Sebby. Jack young Jim Alsey Ann(?) & Feliza with their increase to be applied to and for the use of Fanny Bisop my daughter during her natural life, or until my said daughter Fanny Bishop marries but in the event of her marriage then and in that case it is my will and desire that Jim Punch and his wife Sebby, Ann and Eliza be equally divided among all my children or their legal representatives. In the event of the mariage of my daughter Fanny Bishop then and in that case it is further my will and desire and I do bequeath to my Executors hereafter to be named to be named three negroes (viz) Jack young Jim and Alsey a girl for the use of Fanny Bishop during her life and at her death to be equally divided among all my children or their legal representatives. It is further my will and desire and I do give and bequeath to my daughter Fanny Bishop out of my Estate Twelve Hundred dollars in cash one bed and ____furniture and bedsteads Two horses three cows and calves & three sows & pigs all her choice. One chest one yoke of Oxens and cash(?) farming tools ___ with all the cash notes, Bonds & Book accounts that I may be in possession of at my death in addition to what she may have heretofore given her. Item 9th It is my will and desire and I do hereby give and bequeath to my Executors hereinafter to be named three negores viz. Ben a Boy and Bill a Boy and Nancy a Girl all these children of Sibby's to be applied to and for the use of Jane Fielder during her life and after her death to her legal children if any in fee simple, but in case of no child nor children legal heirs then it is further my will and desire the three negroes (viz) Ben Bill and Nancy with increase to be equally divided among all my children or there legal representatives. Also it is my will that Jane Fielder my granddaughter have one bed bedstead & furniture and one small trunk and remain with my daughter Fanny Bishop and under her care with her property until the said Jane Fielder marries or arrives to the age of Twenty one(?) years. It is further my will and desire that the most liberal Construction be given ___ any part of the demise herein made to this my will in all cases including increase and the legal representatives &G (?) Item 10th It is further my will and desire and I do hereby require that all my household and kitchen furniture Stock of all kinds farming utensils waggon and geer with all other property not otherwise divided is to be sold at the discretion of my Executors hereinafter to be named and equally divided among all my children or their legal representatives. I the said Stephen Bishop do hereby nominate Constitute and appoint William Hagerty Asa Bishop and William Noble my lawful Executors to execute this my last will and Testament hereby nullifying and revoking all former wills and Testaments legacys and bequests heretofore made ratifying and Confirming this and no other to be my last Will and Testament given under my hand and Seal this February 15th day of 1821. Stanley Robert Allen Georgia Court of Ordinary September Term 1821 Personally appeared in open Court Thomas Wilburn & Ezkiel Stanley two of the subscribing witnesses to the foregoing with who being duly sworn say that they saw the above named Stephen Bishop sign and heard him acknowledge the same as his last will and Testament & that they each believed him to be of perfect sound mind and memory at the time of his so doing and that they together with John Williams and Robert Allen subscribed these names as witnesses thereto in the presence of the Testator Sworn to and Subscribed in the Thomas Wilburn Open Court 3rd September 1821 E.
